And whereas the Commission was prevent from considering this matter by various Court actions until November 1983, at which time it advertised its intention to hear the case, commencing on 7 February 1984.

And whereas the Examiner by means of a supplementary report dated 2 February 1984 advised the Commission that at a meeting on 27 January 1984, Flipp indicated that it would be willing to take steps which would result in the abandonment of the trade practice.

And whereas the Examiner reported that the steps taken by Flipp, as detailed in his supplementary report, satisfied both the Examiner and Soutar that the trade practice has been abandoned.

And whereas the Commission has noted and accepts that the trade practice which was the subject of the Examiner's 1981 report no longer exists.

Now therefore the Commission resolves:
(1) Under section 40 (4) of the Act, to dispense with any further inquiry into this matter; and
(2) Under section 22 (2) of the Act, not to make an order in respect of the Examiner's report dated 6 November 1981.

(b) The proportion of New Zealand and imported material used in manufacture;
(c) Present and potential output; and
(d) Details of factory cost in terms of materials, labour, overhead, etc.

(b) The landed cost and selling price, including customs value, and cost into store in terms of f.o.b., insurance, freight, exchange, other landing charges, duty, etc., of equivalent goods of overseas origin.
