would have been the responsibility of, the Hawke’s Bay
County Council;
(d) Shall succeed to the bylaws which are in force and which are
applicable to the authority’s altered circumstances and, until
revoked or altered by the Napier City Council, every such
bylaw shall remain in force in the area in which it was in
force immediately before the alteration of boundaries; and
every bylaw which cannot be restricted to the area shall
be deemed inapplicable and revoked in respect of the area
by the alteration of boundaries;
(c) Shall succeed to all rates or levies and other money payable
to the Hawke’s Bay County Council;
(f) Shall succeed to the valuation rolls, electoral rolls, and rate
records in force in the areas, and these shall remain in
force until such rolls or records are made by the Napier
City Council; and until that time Part IX of the Rating
Act 1967 shall apply as if the district in which the said
areas were included was the district of a special purpose
authority and the areas from which it was formed were
constituent districts.

Vesting of land—The corporation of Napier City shall, in respect
of the said areas, have vested in it, subject to all existing encum-
brances, all land in those areas vested in the corporation of Hawke’s
Bay County. -
Mayor and principal administrative officer—The mayor and
principal administrative officer of the Napier City Council shall
exercise the duties, powers, and functions of the chairman and
principal administrative officer of the Hawke’s Bay County Council
in respect of the said areas. -
Creditors—Subject to section 37F of the Local Government
Act 1974, the rights or interests of creditors of any district affected
by this order shall not be affected. -
Rating—The system of rating in the said areas shall continue
to be the land value system. -
Apportionment of assets and liabilities—(1) The Napier City
Council shall pay to the Hawke’s Bay County Council the sum of
$13,335.52 of which sum $5,000.00 shall be reimbursement for
design engineering fees and $8,335.52 shall be payment towards a
sewer pump station at Awatoto.
(2) Except as provided in subclause (1) of this clause there shall
be no apportionment of assets and liabilities, including loan
liabilities.
SCHEDULE
ALL those areas in the Hawke’s Bay Land District, being described
as:
Firstly, bounded by a line commencing at a point being the south-
eastern corner of part Lot 1, D.P. 14906 as shown marked A on
S.O. 7652 and proceeding westerly along a right line to and along
the southern boundaries of part Block 94, Puketapu Crown Grant
District, part Section 15 and Section 43, Block IV, Heretaunga Survey
District to the south-easternmost corner of Lot 1, D.P. 12689;
then north-westerly along the north-eastern boundary of Lot 1,
aforesaid to the eastern side of Oak Road; thence northerly along
the eastern side of that road to a point in line with the north-eastern
boundary of Lot 2, D.P. 13042 to the easternmost corner of
that lot; thence westerly along the northern boundaries of Lot 2,
aforesaid, to a point due south of the south-easternmost corner of
Lot 1, Deeds Plan 714; thence due north along a right line to that
south-easternmost corner and westerly, northerly, easterly, and
southerly along the southern, western, northern, and eastern bound-
aries of Lot 1, aforesaid, to the western side of Oak Road; thence
south-easterly along a right line, bearing 135 degrees, to the eastern
side of Oak Road; thence northerly along that eastern side to the
southern boundary of part Lot 1, D.P. 14906; thence easterly
along the southern boundaries and easterly and south-easterly along
the northern and north-eastern boundaries of part Lot 1, D.P. 14906,
as shown marked A on S.O. 7652 to the south-eastern boundary of
part Lot 1, aforesaid; thence south-westerly along those boundaries
to the point of commencement;
And secondly, bounded by a line commencing at a point on the
mean high water mark of the ocean being the south-eastern corner
of Section 7, Block I, Clive Survey District and proceeding westerly
along the southern boundary of Section 7, aforesaid, to and south-
erly along the eastern side of No. 2 State Highway to a point in line
with the northern boundary of Section 56, Block I, Clive Survey
District; thence westerly to and along the northern boundary of Sec-
tion 20, Block XII, Heretaunga Survey District, to the western side
of McLeod Road; thence northerly along the western sides of that
road and the production of the last roadside to the northern side
of Mecanee Awatoto Road; thence easterly along the northern sides
of that road to and northerly along the western sides of Te Awa
Avenue to the north-eastern corner of Lot 10, D.P. 6396; thence
easterly along the production of the northern boundary of Lot 10,
aforesaid, to the western side of the Palmerston North - Gisborne
Railway; thence northerly along that western side and its produc-
tion to the northern side of Ellison Street; thence easterly along that
northern side and its production to the mean high water mark of
the ocean; thence southerly along the mean high water mark of the
ocean to the point of commencement;
And thirdly, bounded by a line commencing at a point being the
south-easternmost corner of part Lot 1, D.P. 14906, as shown on
S.O. 8537 and proceeding westerly and northerly along the southern
and western boundaries of part Lot 1, aforesaid, as shown on
S.O. 8537 and northerly, easterly and northerly along the western,
northern and western boundaries of part Section 23, Ahuriri Lagoon
as shown on S.O. 8537 to and northerly along the western boundary
of Section 17, Block IV, Heretaunga Survey District, to the north-
ernmost corner of Section 23, Ahuriri Lagoon and the
northern boundary of Section 25, Block IV, Heretaunga Survey Dis-
trict, to and again along the northern boundary of part Section 23,
Ahuriri Lagoon, to and southerly, westerly, and northerly along the
eastern, southern, and western boundaries of Lot 1, D.P. 11043, to and
westerly, northerly, and easterly along the southern, western, and northern
boundaries of Section 35, Block XVI, Puketapu Survey District, to
and northerly along the western boundary of Lot 1, D.P. 11043 to
the northernmost corner of Lot 1, aforesaid; thence easterly along
the northern boundaries of Lot 1, aforesaid and Lot 3, D.P. 11043
and the production of the last-mentioned boundary to the north-
eastern side of No. 2 State Highway; thence south-easterly along the
north-eastern side of that highway to the southernmost corner of
Lot 2, D.P. 2531; thence southerly along a right line to the north-
ernmost corner of Lot 1, D.P. 11351 and southerly along the eastern
side of Embankment Road to a point in line with the northern
boundary of part Lot 2, D.P. 14906; thence westerly to and along
that boundary and southerly along the western boundary of part
Lot 2, aforesaid, to the point of commencement.
And fourthly, 5,620 square metres, more or less, being Lot 1,
D.P. 15646, situated in Block VIII, Heretaunga Survey District. All
certificate of title H2/1305.

the Queen has been graciously pleased to approve the retention of
the title “The Honourable” by:
Sir John Barry O’Regan
on his retirement as a Judge of the High Court of New Zealand on
14 February 1984.

Appointment of Member of Broadcasting Tribunal
PURSUANT to section 61 (1), (2), and (6) of the Broadcasting Act
1976, His Excellency the Governor-General has been pleased to
reappoint
Lionel Ralph Sceats of Howick, near Auckland
to be a member of the Broadcasting Tribunal for a term of 3 years
commencing on the 1st day of February 1984.
