Guide to Import Licence Tendering (Excluding Tendering under ANZCERT) November 1984
(This supersedes the Guide issued in January 1984)
Introduction
-
These notes set out the provisions for tenders called from time
to time for the issue of global import licences including those under
industry development plans. Special provisions might be introduced
for tendering under industry development plans from time to time.
These guide notes cover the special provisions for tendering under
the Australia/New Zealand Closer Economic Relations Trade
Agreement which relates to goods from Australia only. -
Import licence tendering derives from the Import Control
Regulations 1973, Amendment No. 3 and is administered by the
Department of Trade and Industry. Except as may be stipulated in
this guide, licences granted under tendering will be subject to the
usual procedures, and terms and conditions, laid down pursuant to
the Import Control Regulations 1973, and nothing in these guidelines
limits any provision of those regulations. -
The Registrar of Import Licence Tendering administers
tendering. The address is P.O. Box 3146, Wellington. -
The objectives of import licence tendering are:
• to allocate import licences on an open and competitive basis;
• to introduce more import competition into the domestic
production sector;
• to widen the base of information available on industry
competitiveness so as to facilitate the move away from import
licensing to the Tariff as the main means of protection.
Who May Bid
- Import licence tendering is open to all entities which are entitled
to obtain an import licence in normal circumstances, i.e., persons
or firms domiciled in New Zealand (see Import Licensing Schedule
for "Who Can Apply").
Register of Tenderers
-
A Register of Tenderers is maintained by the department. Each
tenderer is allocated a confidential registration number. The
registration number must be entered on all bid forms submitted.
The Registrar may require a tenderer on the Register to provide
evidence of the intention and ability to import the goods bid for.
If satisfactory evidence is not forthcoming the tendering bids could
be declared invalid and the registration cancelled. -
Tenderers on the Register receive free of charge all mailings
of the Calls for Tenders, other notes, confirmation of the confidential
registration number and a supply of bid forms. -
Tenderers who submit bids without first having been allocated
a registration number will be given their number at the opening
time. They will be required to use this number in tenders thereafter.
Any Change to Information Held on The Register Should Be
Notified to The Registrar
Calls for Tenders
-
Calls for Tenders will specify the tender number, the item code,
the tariff item, a brief description of the goods involved, the total
number of licence units to be tendered under each tender number
(each unit is for $2,000 unless otherwise stated). Each separate Call
for Tenders is referred to as a Round. The Call for Tenders is
normally open for at least 21 days. -
The Call for Tenders is published in the New Zealand Gazette
or in supplements to the New Zealand Gazette. These are posted
to tenderers on the Register or may be purchased from bookshops
of the New Zealand Government Printer. These bookshops are listed
at the back of these notes. -
The Registrar may amend the Call for Tenders and withdraw
tenders where necessary. Amendments will be published in the New
Zealand Gazette. The Registrar may attach conditions to tenders.
How to Bid
- Bid forms T&I 335C are supplied with the mailing of the New
Zealand Gazette or they may be obtained from any office of the
department. The forms are designed to allow 5 bids under 8 different
tender numbers. If more than 5 bids per tender number are required
2 or more bidding panels may be used for the same tender number.
To complete the bid form:
(a) Fill in the correct tender number from the New Zealand Gazette
in each of the bidding panels used.
(b) Enter the number of licence units sought (each unit is for $2,000
unless otherwise stated).
(c) Enter the amount bid per unit. Zero bids may be made. Zero
bids should be entered as 0. Other bids should be in whole
dollars.
(d) Enter your registration number. Failure to do so will invalidate
the bids. See paragraph 8 however.
(e) Fill in the importer's code. This may be obtained from the
Customs Department. This is used as a check on the
computer against the registration number. Failure to enter
this code will not of itself invalidate bids.
(f) Fill in the name and address section.
(g) Sign the form. Failure to do so will invalidate the bids.
The Bid Must be Typed and Signed in Ink.
Several Bids Forms May be Sent in One Envelope.
Only Original Typed Bids Should be Sent.
Carbon Copies Are Not Accepted.
Duplicate Copies Are Not Required.
Responsibility for Classification
- It is the responsibility of the tenderer to ensure that the goods
to be imported against a given tender number are correctly classified
in the Tariff item(s) and/or Statistical Keys included in the relevant
tender number. It is likewise the responsibility of the importer to
observe all statutory regulations pertaining to the goods concerned.
Import Documentation
- Tender import licences are frequently issued on a Tariff Item
or Statistical Key basis. It is essential that the descriptions of goods
on overseas suppliers' invoices are in accordance with descriptions
in the New Zealand Customs Tariff, i.e. the description must be
sufficiently specific to enable Port Officers to determine the
appropriate Statistical Key for the goods when they are being cleared.
