MATTER of the will of MARY EDITH BRUCE late of Oamaru, retired
registered nurse deceased, and IN THE MATTER of an application
by WAITAKI HIGH SCHOOL BOARD for approval of a scheme for
variation of a trust:

PARTICULARS OF THE SCHEME

The trust established pursuant to the provisions of clause 6(b) of
the last Will and Testament of Mary Edith Bruce late of Oamaru,
registered nurse, deceased, provides that the net annual income
accruing therefrom is to be applied in establishing one or if funds
permit more prizes to be awarded annually to pupils in each of the
5th, 6th and 7th Forms of the Waitaki Girls High School who, in
the opinion of the Principal, the First Assistant and the President
of the Waitaki Old Girls’ Association for the time being, exhibit
aptitude both in class and in sport, good character, courtesy
and interest in community affairs, Such prizes to be known as the “Mary
Edith Bruce Citizenship Prizes”. At the present time the amount
of income accrued in the Trust Fund far exceeds the amount required
for the prizes. A scheme for Variation of the Trust has been approved
by the attorney-general whereby it is proposed that in any income
year where there is a balance remaining in the Trust Fund such
remaining income shall be divided equally for the following purposes:

(i) For the purchase of library books of an educational and/or
reference nature solely for the benefit of pupils of
Waitaki Girls High School and for the establishment of a
Memorial Bay called “the Mary Edith Bruce Citizenship
Bay” in the School Library in which the books purchased
could be placed.

(ii) For the purchase of extraordinary capital equipment for
education purposes solely for the benefit of pupils of
Waitaki Girls High School.

This application will be heard in the High Court at Timaru on
Monday the 19th day of November, 1984.
