Because few pupils from the school undertake further education
and because the fund is larger than necessary to establish a tertiary
level scholarship it is inexpedient to give effect to the terms of the
trust.
The proposed scheme if approved by the Court will substitute
new trusts pursuant to which:
-
Two-fifths of the annual income from the trust fund will be
used to establish and maintain the scholarship known as
the W. N. Campbell Scholarship. The Scholarship will be
available to assist past and present pupils of the Catlins
Area School (formerly known as the Owaka District High
School) to undertake courses of study at tertiary level
institutions. -
One-twentieth of the annual income of the trust fund will be
used for the purchase acquisition and presentation of prizes
to pupils of the Catlins Area School for the writing of essays,
poetry or both. -
One-twentieth of the annual income of the trust fund will be
used to purchase books relating to English Literature for
the Catlins Area School library. -
One-tenth of the annual income of the trust fund will be used
for the teaching of English Language and literature at the
Catlins Area School. -
Two-fifths of the annual income of the trust will be used for
the promotion and development of the cultural knowledge
and appreciation of pupils of the Catlins Area School and
members of the Owaka Community.
If the scheme is approved the Trustees shall control the trust
fund, its investment and the collection of income derived from its
investment. The Trustees shall pay the income realised by the trust
fund to the Otago Education Board.
The Otago Education Board shall be responsible for the
expenditure of all trust income and the administration of the trusts
established by the scheme.
An advisory committee consisting of representatives of the school,
the Otago Education Board and the Owaka Community shall be
established to consider applications for the W. M. Campbell
Scholarship and recommend suitable recipients to the Otago
Education Board and to submit proposals to the Otago Education
Board for the expenditure of trust money not allocated to the
scholarship.
A copy of the will of the late William Mortimer Campbell, the
scheme and the report of the Attorney-General may be inspected
free of charge at the office of the Registrar, High Court, Dunedin
and at the offices of Messrs Ross, Dowling, Marquet and Griffin,
Solicitors, 33 Princes Street, Dunedin.
This application for approval of the scheme will be heard in the High
Court at Dunedin on Wednesday, the 14th day of March 1984, at
10 o'clock in the forenoon.
Any person desiring to oppose the scheme is required to give
notice of his or her intention to oppose the scheme to the Registrar
of the High Court at Dunedin and to the Trustees whose address
for service is at the offices of Messrs Ross, Dowling, Marquet and
Griffin, 33 Princes Street, Dunedin and to the Attorney-General not
less than 7 clear days before the date proposed for the hearing of
the application by the Court.
