Information, Instructions and Procedures Regarding Tendering for Round 17

  1. Rules of Origin
    It should be noted that ANZCERT licences are for goods of Australian origin only, i.e., products which meet the criteria for Australian origin as contained in the Customs Regulations 1968, as amended. The New Zealand - Australia Rules of Origin are detailed in Article 3 of the ANZCERT Agreement.

  2. It is recommended that prospective tenderers read carefully the Supplement (No. 11) to the New Zealand Gazette of Thursday, 2 February 1984, published Wellington, Friday, 3 February 1984, entitled “ANZCERT: 1984-85. TEAL AND MEAL Allocation Procedures”. This has been reproduced on green paper by the department as a “Guide to Import Licence Tendering: ANZCERT TEAL AND MEAL Allocation Procedures”. These have been supplied to those on the department’s register of tenderers in previous mailings. Copies are also available on request from the department’s offices.

  3. Tendering Format
    Pink bid forms must be used when tendering under ANZCERT. Pink ANZCERT bid forms are available only from Department of Trade and Industry offices, in Auckland, Wellington, Christchurch and Dunedin. Those who are on the department’s register of tenderers will receive a copy of this Gazette containing the call for tenders, a supply of bid forms and notes as appropriate.
    A separate form is required for each tender number.

  4. Tender Procedures
    Tenderers must put their registration numbers on each bid form. Bids will be invalid without a registration number. An exception is if the tenderer is not yet registered, in which case a number will be allocated when bids are processed. Tenders close at 5 p.m. on Monday, 8 October. Bids must be with the Registrar, Import licence Tendering, Department of Trade and Industry, P.O. Box 3146, Wellington, or must be delivered by hand to the Registrar, First Floor, Bowen State Building, Bowen Street, Wellington, by 5 p.m. on the closing date.

No late tenders will be accepted.

Envelopes must be clearly marked “ANZCERT Import Licence Tender” on the bottom right-hand corner.

  1. Notes
    (a) Tenderers are advised that some item codes contain tariff items that include goods which are exempt import licence or licence on demand when of Australian origin. It should be noted that the TEALs are not available for such goods because licences are not required for exempt goods and, where goods are subject to licence on demand, import licences are issued on application to the Collector of Customs.
    (b) The Call for Tenders contains a brief description of the goods being tendered. For a full identification of the goods concerned and other details, tenderers should refer to the Import Licensing Schedule and to the Customs Tariff and should consult the Department of Trade and Industry or the Customs Department.
    (c) Licences issued under this Call for Tenders will be for goods from Australia which comply with the ANZCERT rules of origin as detailed in the Agreement. Enquiries should be directed to the Collector of Customs.
    (d) Tenderers should be conversant with the various statutes and regulations governing the importation and sale of the goods tendered.
    (e) Where a premium is payable invoices will be sent to the successful tenderers. Where a tenderer makes a number of successful bids under a tender number, the premiums payable and the value of the licences won will be aggregated into single documents. On receipt of payment licences will be issued as licence type 9—CER Tendered Exclusive Australian Licences.
    (f) Where premiums are payable, payment must be made within 6 months of the date of the invoice. If not paid after 6 months, the licence will be made available for reallocation, in the first instance to the highest unsuccessful bidder/s. Firms not paying premiums due are barred from further tendering until the debt is cleared.

CALL FOR ANZCERT TENDER ROUND 17

Pursuant to the Import Control Regulations 1973, Amendment No. 3 (S.R. 1980/246) and within the terms of the Australian-New Zealand Closer Economic Relations Trade Agreement (ANZCERT), the Secretary of Trade and Industry, acting under delegated authority, is calling tenders for import licences (Tendered Exclusive Australian Licences—TEALs) for the goods specified below under I, II, III and IV:

I UNUSED 1983—84 MANUFACTURERS’ EXCLUSIVE AUSTRALIAN LICENCES (MEALS)
(Except for those tender categories in which there was 1984—85 Residual Exclusive Australian Licence after Round 13).

NOTES:
(a) Manufacturers who did not use 75 percent of their 1983–84 Manufacturers’ Exclusive Australian Licences (MEALs) are not permitted to bid for licence in the item code in which they held the unused MEALs. However, manufacturers who used more than 75 percent of their 1983–84 MEALs are free to tender for this licence. (Under the normal rules for the allocation of Exclusive Australian Licence, MEAL-holders are not permitted to hold Tendered Exclusive Australian Licence).
(b) Please note that for item code 41.010, which is advertised in dollar terms, licences will be issued in quantity terms according to the following nominal conversion rate: $23.32 = 1 square metre.
(c) The amounts of licence tendered below include an increase of 25 percent made to compensate for the effects of devaluation.
(d) Licences issued will be valid to 30 June 1985.
(e) Appendix B

  1. Pursuant to Annex C of the ANZCERT Agreement, in the item codes listed below the Exclusive Australian Licences are only available for goods excluding components of a kind commonly used with:
    (a) Tractors for articulated vehicles, being tractors that are designed for operation solely or principally on the highway; or
    (b) Vehicles of Tariff Heading 87.02, other than air-cushioned vehicles or assembled convertible road/rail motor coaches.
