MEMORANDUM OF VARIATION (OF HEADS OF
AGREEMENT)
MADE THIS 17th DAY OF JULY 1984.

PARTIES: (i) The Minister of Tourism.
(ii) The Minister of Lands.
(iii) The Rotorua District Council.

(i) WHEREAS by a Memorandum of Heads of Agreement dated
the 31st day of May 1983, the above parties inter alia jointly
and severally agreed that the land known as the Sanatorium
Reserve including the Government Gardens Rotorua, being
Part Sections 2 and 3 Block 1 Tarawera Survey District
comprising 74 hectares more or less (hereinafter referred
to as “the said land”) should be removed from the control
of the Minister of Tourism and removed from the operation
and provisions of the Tourist and Health Resorts Control
Act 1908 and thereafter vested in the Rotorua District
Council to be held and administered subject to the terms
and conditions therein expressed.

(ii) AND WHEREAS the said memorandum provided that the
effective date of formal transfer of the said land would be
1 June 1983 such date to be notified in the New Zealand
Gazette facilitating such vesting in the Rotorua District
Council in terms of the Reserves Act 1977.

(iii) AND WHEREAS such Gazette notices were not so published
by the 1st June 1983 and the Rotorua District Council has
had possession of the said land since that date.

(iv) AND WHEREAS the parties are desirous of varying the said
memorandum to provide for a fresh effective date.

NOW THIS MEMORANDUM OF VARIATION WITNESSETH

  1. The effective date of the formal transfer of the land shall be
    that of the day after the date of publication of the notice in
    the New Zealand Gazette facilitating the vesting of the said
    land in the Rotorua District Council in terms of Section 26
    of the Reserves Act 1977 and the said notice shall so provide.

  2. (i) Upon the cancellation of the vesting of the control of the said
    land in the Minister of Tourism and the removal of the said
    land from the operation and provisions of the Tourist and
    Health Resorts Control Act 1908 pursuant to Section 27 of
    the Reserves Act 1977 and

(ii) Until such time as the said lands are vested in the Rotorua
District Council pursuant to Section 26 of the Reserves Act
1977.

(iii) The Minister of Lands will delegate and hold delegated
pursuant to Section 10 of the Reserves Act 1977, his powers
pursuant to Sections 42, 43, 44, 45, 48, 49, 50, 51, 53 and 54
of the Reserves Act 1977 in respect of the said lands
PROVIDED HOWEVER that the exercise of such delegated
powers by the Rotorua Council shall not be exercised in a
manner inconsistent with the said memorandum.

  1. Save as hereinbefore expressly varied the said memorandum
    shall remain in full force and effect.

PURSUANT to section 120 of the Transport Act 1962 as amended
by the Transport Amendment Act (No. 2) 1983, the No. 10, District
Transport Licensing Authority (F. H. K. Moore) gives notice of the
receipt of the following application and will hold a public sitting
in the Conference Room, Ministry of Transport, 245 Cumberland
Street, Dunedin on Thursday, 2 August 1984 commencing at
9.30 a.m. to hear evidence for or against granting it.

A84/109 Knopp Cartage Limited, Fairfield. Application for a new
goods service licence, with one Rail Exemption Certificate to read
as follows: “Exempt from section 109 (1) of the Transport Act 1962
within the area bounded by the extremities of the Balclutha Borough
in the south and Dunedin City in the north along the main route
between such extremities for goods which have been or are to be
conveyed by rail from or to the Dunedin Railway Station pursuant
to the Mogal Freight and Daily Freight bulk tonnage contracts with
New Zealand Railways Corporation.”

of washed and unwashed green sheep and green cattle skins through

section 109 of the Transport Amendment Act (No. 2) 1983. Six rail
exemption certificates required.
