(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second Schedule hereto to be stopped, and declares that:
(i) The areas marked ‘H’ and ‘F’ on the plan shall vest in The Southland County Council.
(ii) The area marked ‘G’ on the plan shall be amalgamated with the land in certificate of title, Volume 161, folio 255.

(c) Declares the land described in the Third Schedule to be taken under section 119 (1) of the Public Works Act 1981, and declares that:

Easement Granted for Right of Way in Block II, Te Mata Survey District, Hawkes Bay County

PURSUANT to section 103 of the Public Works Act 1981, the Minister of Works and Development grants to Gregory Marc Beecham of Hastings, medical practitioner, the easement described in the First Schedule hereto, which is to be forever appurtenant to the land described in the Second Schedule of the Land Transfer Act 1952.

FIRST SCHEDULE
EASEMENT GRANTED

A right of way easement in favour of Gregory Marc Beecham (together with his successors in title called the grantee) over that piece of land containing 7049 square metres, being part Lot 1, D.P. 12677; marked C on S.O. Plan 6778, lodged in the office of the Chief Surveyor at Napier. There shall be implied in favour of the grantee the rights and powers set forth in the Seventh Schedule of the Land Transfer Act 1952.
