Water Supply Pipeline Easement in Gross Acquired for a State Primary School in Block III, Mangamuka Survey District, Hokianga County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, agreements to that effect having been entered into, a water pipeline easement in gross over the land described in the First and Second Schedules hereto is hereby acquired for a State primary school, vesting in the Crown the rights and powers contained in paragraphs 2 and 5 of the Seventh Schedule to the Land Transfer Act 1952 and subject in the case of the land described in the First Schedule hereto to the rights and conditions contained in the Third Schedule hereto on the 2nd day of February 1984.

The owner shall have the right during the continuance of the easement to connect and lead from the line of water pipes over the servient land described in the First Schedule hereto a subsidiary line of water pipes for the purpose of conveying and leading therefrom water for use in the owners property, provided however that the owner shall not unreasonably restrict, impede or diminish in any way the supply of water to the property of the Crown the location of such connection and subsidiary pipeline to be agreed upon by the owner and the Crown.
