(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the Waitemata City Council;

(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the Waitemata City Council;

(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the Waitemata City Council;

(d) Shall succeed to the bylaws which are in force and which are applicable to the authority’s altered circumstances and, until revoked or altered by the Glen Eden Borough Council, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the area by the alteration of boundaries;

(e) Shall succeed to all rates or levies and other money payable to the Waitemata City Council;

(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the area, and these shall remain in force until such rolls or records are made by the Glen Eden Borough Council, and until that time Part IX of the Rating Act 1967 shall apply as if the district in which the area was included was the district of a special purpose authority and the areas from which it was formed were constituent districts.

  1. Vesting of land—The corporation of Glen Eden Borough shall, in respect of the said area, have vested in it, subject to all existing encumbrances, all land in that area vested in the corporation of Waitemata City.

  2. Mayor and principal administrative officer—The mayor and principal administrative officer of the Glen Eden Borough Council shall exercise the duties, powers, and functions of the mayor and principal administrative officer of the Waitemata City Council in respect of the said area.

  3. Creditors—Subject to section 37F of the Local Government Act 1974, the rights of interest of creditors of any district affected by this order shall not be affected.

  4. Rating—The system of rating in the said area shall continue to be the land value system.

SCHEDULE

ALL that area in the North Auckland Land District containing 6025 square metres, more or less, bounded by a line commencing at the north-eastern corner of part Allotment 544, Waikomiti Parish, in Block II, Titirangi Survey District, and proceeding south-easterly for a distance of 94.74 metres (470.96 links) along the north-eastern boundary of part Allotment 544 to the south-western corner of an area of 6.1 perches on S.O. Plan 47208; thence easterly along the southern boundary of that area of 6.1 perches, aforesaid, and its production 9.7 metres (48.33 links) on S.O. Plan 33283 to the angle in the north-western boundary of an area of 0 acres 1 rood 33.58 perches taken for Railway by Proclamation published in New Zealand Gazette, 1945, page 1535, and shown on S.O. Plan 33283; thence north-easterly along the north-western boundary of the aforesaid area to its northernmost corner; thence north-westerly along the north-eastern boundary of an area of 3.6 perches on S.O. Plan 33283 to its westernmost corner; thence westerly along a right line to the point of commencement.

The Manawatu Drainage District Boundaries Alteration Order 1984

THE RT. HON. SIR ROBERT MULDOON PRESIDING IN COUNCIL

PURSUANT to section 36 of the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

ORDER

  1. Title and commencement.—(1) This order may be cited as the Manawatu Drainage District Boundaries Alteration Order 1984.
    (2) This order shall come into force on the 1st day of April 1984.

  2. Boundaries of Manawatu Drainage District altered—The boundaries of the Manawatu Drainage District (hereinafter referred to as “the district”) shall be altered by including in the district:

(a) An adjoining area to the north of the district in the vicinity of Aorangi Road and Reid’s Line as described in the First Schedule to this order;

(b) An adjoining area to the south between the district and the Manawatu River as described in the Second Schedule to this order.

  1. Taonui Drain—That part of the Taonui Drain within the district shall, for the purposes of section 25 of the Land Drainage Act 1908, be under the management of the Manawatu Drainage Board.

FIRST SCHEDULE

ALL that area in the Wellington Land District bounded by a line commencing at a point on the left bank of the Oroua River at its intersection with the south-western boundary of Section 9, Block XIV, Oroua Survey District, and proceeding north-easterly along the said bank to, and easterly along the north-western and north-eastern boundaries of Section 3, Block XIV, Oroua Survey District and the production of the last-mentioned boundary to the south-eastern side of Aorangi Road; thence north-easterly along the south-western side of Aorangi Road to, and south-easterly along the south-western side of Reid’s Line East and its production to the middle of Taonui Road; thence south-westerly along the middle of Taonui Road to a point in line with the south-western boundary of Lot 10, D.P. 43; thence north-easterly and generally north-westerly and generally north-westerly along the boundaries of the Manawatu Drainage District as described in Gazette, 1967, pages 515 and 810, to the point of commencement.

SECOND SCHEDULE

ALL that area in the Wellington Land District bounded by a line commencing at a point in the middle of the Manawatu River in Block XIII, Kairanga Survey District in line with the south-western side of Karere Road, and proceeding generally south-westerly down the middle of that river to a point in line with the western boundary of part Lower Aorangi 3G taken for drainage works as described in Gazette, 1895, page 1447, thence generally north-easterly along the boundaries of the Manawatu Drainage District as described in Gazette, 1953, page 537, to the point of commencement.
