✨ Miscellaneous Notices
2034 THE NEW ZEALAND GAZETTE No. 93
Messrs: J. V. B. McLinden, L. W. Malcolm.
Hearing: 15 June 1983.
Decision: 23 June 1983.
Appearances: Mr Hillman for Comptroller of Customs.
No appearance of importer, Mr B. Partridge, Newlands.
DECISION
THESE publications are single copies imported privately through Wellington parcel post in January 1983. Forfeiture has been disputed by the importer so that the Comptroller has referred the matter to the Tribunal for classification. In his submissions Mr Hillman said:
"Transvestites Transformed, Transvestite Castle and Transvestites in Bondage and Female Domination, are all in a similar format. They consist mainly of written material, interspersed with drawings and photographs. The material depicts various forms of transvestism, female domination and bondage in an explicit manner.
The Centurians Catalogue, the Whole Catalogue of Exotic Catalogues, the Centurians sales pamphlet and the Centurians video sales pamphlet all feature various forms of sexual activity such as bondage and rubber fetishism. A larger version of the advertising material entitled "The Whole Catalogue of the Exotic and Bizarre was classified as unconditionally indecent by the Tribunal in Decision 1039 of 7 October 1982."
Having perused the magazines concerned and the catalogues the Tribunal has no hesitation in accepting the submissions made on behalf of the Comptroller. In the view of the Tribunal, some of the bondage illustrations could easily result in immature persons attempting to follow some of the illustrations with a possibility of serious injury.
The Tribunal has no difficulty in finding all these publications indecent.
District Court Judge W. M. WILLIS, Chairman.
