Declaring Land Acquired for a Government Work and Not Required for that Purpose to be Crown Land
Pursuant to section 42 of the Public Works Act 1981, the Minister of Works and Development hereby declares the land described in the Schedule hereto to be Crown land, subject to the Land Act 1948, on the 30th day of June 1983.
SCHEDULE
GISBORNE LAND DISTRICT
All that piece of land containing 1.5959 hectares, situated in Block VIII, Hangaroa Survey District, being part Section 9. All certificate of title 4C/1478.

Declaring an Easement in Gross for Water Supply and Pipeline Purposes to be Acquired Over Land in the City of Wellington
Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, an easement in gross in perpetuity for water supply and pipeline purposes is hereby acquired over the land described in the First Schedule hereto and shall vest in the Wellington Regional Council on the 30th day of June 1983 and shall confer upon the said council the full and free rights, liberties, licences, and privileges in perpetuity hereinafter set forth in the Third Schedule hereto but subject to the provisos set forth in the Third Schedule hereto.
FIRST SCHEDULE
WELLINGTON LAND DISTRICT
All that piece of land marked as Area “B” on D.P. 48915, over part of Lot 2 on D.P. 17524 as presently comprised and described in certificate of title, Volume 655, folio 2, Wellington Land Registry.
SECOND SCHEDULE
The full and free right and liberty and licence in perpetuity to carry conduct and convey fresh water backwards and forwards under and along the said land, together with the further rights, liberties, licences, and privileges in perpetuity hereinafter set forth to say:
(a) The right to enter upon all or any of the said lands to lay, construct, repair, renew, and maintain all surface boxes of such internal diameter and of such material and at such depth as shall be necessary for any of the purposes hereunder;
(b) The right to enter upon all or any of the said lands from time to time and at all reasonable times (subject to the proviso set forth in the Third Schedule hereto) by its servants, agents, and workmen, with all necessary tools, implements, and machinery (but not motor vehicles) for the purposes of laying, constructing, repairing, renewing, and maintaining all or any of the pipes, tobies, valves, and surface boxes;
(c) The right to dig and break up the surface of the said lands or any parts thereof and generally to do and perform all acts and things as may be necessary or proper for any of the purposes herein mentioned; and so that no buildings or walls shall be erected or trees planted on the said land without the consent of the said Wellington Regional Council.
THIRD SCHEDULE
The rights, liberties, licences, and privileges set forth in paragraphs (a), (b), and (c) of the Second Schedule hereto shall not without the prior written consent of the registered proprietors of the said lands be exercisable on any Saturday, Sunday, or public holiday and on any other day shall be exercisable only between the hours of 9 o’clock in the morning and 5 o’clock in the afternoon.
Provided further that the said Wellington Regional Council will at all times indemnify and save harmless the registered proprietors
of the said land from all actions, suits, proceedings, claims, and demands whatsoever which may be made or brought against the said registered proprietors as a result of the exercise or attempted or purported exercise of any of the rights hereinbefore conferred; and the council in any exercise of any of the said rights shall cause as little inconvenience as possible to the said registered proprietors and shall restore the surface of the land as nearly as possible to its former condition and repair any damage and the said registered proprietors shall not at any time hereafter do permit or suffer any act whereby the said rights hereby vested in the council may be interfered with or affected.

Land Acquired for Drainage Purposes in Block X, Belmont Survey District, City of Lower Hutt
Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for drainage purposes and shall vest in The Lower Hutt City Council on the 30th day of June 1983.

All that piece of land containing 106 square metres, situated in Block X, Belmont Survey District, being part Lot 35, D.P. 14027, as shown marked “A” on S.O. Plan 33309, lodged in the office of the Chief Surveyor at Wellington.

Declaring an Easement in Gross Over Land to be Acquired for Stream Clearance Purposes in Block XIV, Belmont Survey District, City of Lower Hutt
Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that an agreement to that effect having been entered into, a stream clearance and maintenance easement for stream clearance purposes is hereby acquired over the land described in the First Schedule hereto and shall vest in the Lower Hutt City Council on the 30th day of June 1983 and shall confer upon the council the full and free right, liberty, and licence hereinafter set forth in the Second Schedule but subject to the provisos set forth in the Third Schedule hereto.
FIRST SCHEDULE

All that piece of land situated in Block XIV, Belmont Survey District, being part Lot 23, D.P. 1612; as shown marked “L” on D.P. 50821.
SECOND SCHEDULE
The full and free right, liberty, and licence for all time and at any time hereafter for the council by its engineers, officers, contractors, agents, and workmen with or without machinery and vehicles of any kind necessary or desirable for any of the purposes aforesaid and loaded or unloaded to enter and remain and to pass through back and over that part of the land described in the Schedule hereto as is defined on Deposited Plan No. 50821 and thereon marked with the letter “L” (hereinafter such piece of land referred to as “the easement area”) for any of the purposes aforesaid and generally to do thereon and to perform all such matters, acts, and things as it deems expedient necessary or proper for on in relation to any of the purposes as aforesaid and it is hereby declared by and between the parties that the council shall have but without prejudice or by way of limitation to the generality of the foregoing the following rights, liberties, remedies, licences, powers, and authorities over and with respect to the easement area:

To make repair and maintain any bank, dam, groyne, or other defence against water.

To deepen, widen, straighten, divert, or otherwise improve any watercourse or outfall for water, or remove any groynes, drains,
