EXPLANATORY NOTE

This note is not part of the notice but is intended to indicate its general effect.

This notice sets the conditions under which a current licence holder may fish for acclimatised fish in the Ashburton acclimatisation districts.

District Anglers Notice North Canterbury Acclimatisation District

PURSUANT to section 71 of the Fisheries Act 1983, the North Canterbury Acclimatisation Society hereby gives the following District Anglers Notice.

NOTICE

  1. Title and commencement—This notice may be cited as the District Anglers (North Canterbury Acclimatisation District) Notice 1983, and shall come into force on 1 January 1984.

  2. Interpretation—Words and expressions in this notice which are defined in the Fisheries Act 1983 or the Freshwater Fisheries Regulations 1983 have the meanings so defined.

In this notice the term “high country waters” means Lakes Lilian, Coleridge, Selfe, Evelyn, Grace, Henrietta, Ida, Little Ida, Catherine (also known as Monk), Georgina, Spectacles, Red Lakes, Lyndon Tarn, Lyndon, Rubicon, Pearson, Grasmere, Sarah, Hawdon, Marymere, Vagabonds Inn Tarn, Blackwater, Letitia, Minchin, Sheppard, Taylor, Katrine, Sumner, Mason, Guyon, and Tennyson, and all waters flowing into those lakes; and includes all other lakes and tarns lying west of a line joining—

(a) The white posts at the Lake Coleridge powerhouse on the Rakaia River; and

(b) The white posts at Woodstock on the Waimakariri River; and

(c) The junction of the Hurunui River with the South Branch; and

(d) The junction of the Waiau and Hope Rivers; and

(e) The New Zealand Electricity Department’s bridge over the Clarence River approximately 2.5 km downstream from Lake Tennyson.

  1. Open season—Fishing for acclimatised fish by licence holders shall be permitted during the period from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive), provided that:

(a) There shall be an open season for acclimatised fish from the first Saturday after Queen’s Birthday Weekend to the 31st day of August in the same year (both dates inclusive) in the following waters:

(i) The Waiau River downstream from its junction with the Hope River:

(ii) The Hurunui River downstream from its junction with the South Branch:

(iii) The Ashley River downstream from the Ashley Gorge Road bridge approximately 0.5 km below the Domain:

(iv) The Waimakariri River downstream from the white posts at Woodstock:

(v) The Selwyn River downstream from where the South Springston Road meets that river:

(vi) Lake Forsyth, and the Wairewa and Okuti Rivers downstream from the road bridge over each river on the Little River - Te Oka Bay road:

(vii) Lakes Taylor, Sumner, Coleridge, Lyndon, and Selfe except within 200 m of any stream flowing into those lakes:

(viii) The Rakaia River downstream from the bridge on the main South Road:

(b) There shall be no close season in the Heathcote River, nor in the Avon River except as provided in paragraph (c) (i) of this clause:

(c) No person shall fish—

(i) At any time for acclimatised fish in Taylor’s Drain from its source to its junction with the Wairarapa Stream, in the Avon River from the Armagh Street bridge at Hagley Park to the Barbadoes Street bridge, in the canal commonly called the Wilberforce Diversion which connects Lake Coleridge with the Wilberforce River or in Lake Marion:

(ii) During the period commencing on the 1st day of October in any year and ending with the Friday immediately preceding the first Saturday in November in that year, for acclimatised fish in any high country waters:

(iii) During the months of March and April for acclimatised fish in the Rakaia River and its tributaries above the Lake Coleridge powerhouse, that point being more particularly shown by white posts on the river banks or in any tributary flowing into Lake Coleridge.

Provided that this subparagraph shall not apply to any lakes draining into the Rakaia River above the point specified:

(iv) During the months of March and April, nor take during those months, quinnat salmon in—

(1) The Clarence River above the New Zealand Electricity Department’s bridge approximately 2.5 km below Lake Tennyson, or any tributary of that part of the river:

(2) The Hurunui River above the junction of the South Branch with that river, or any tributary of that part of that river, including Lake Sumner:

(3) The Waiau River above the junction of that river with the Hope River, or any tributary of that part of the Waiau River:

(4) The Waimakariri River above the white posts at Woodstock, or any tributary of that part of that river or the Kowhai River and its tributaries.

  1. Authorised tackle—(1) Every person shall fish for, take or kill acclimatised fish using only a rod and running line provided that for:

(a) playing an acclimatised fish, a landing net or gaff may be used to secure or land any such fish;

(b) taking small indigenous fish for bait in angling, a bait net not over 1.8 metres in length may be used;

(c) keeping alive acclimatised fish lawfully taken with rod and line in the same water, a keep net not over 1.8 metres in length may be used.

(2) No person shall use in fishing for acclimatised fish or have under his control more than one assembled rod and running line at any one time.

(3) No person shall fish for acclimatised fish with a rod and line unless he is in actual attendance within 15 metres of the rod and has the rod under his own visual observation.

  1. Prohibition on unauthorised fishing tackle, etc.—No person shall, when fishing for acclimatised fish or when in possession of an assembled fishing rod and gear suitable for fishing for acclimatised fish, have in his possession or under his control or convey or cause to be conveyed to the vicinity of any place where he is fishing or proposes to fish, any paravane, any stroke-hauling or foul-hooking gear, any spear, any narcotic or poisonous substance or liquid injurious to fish.

  2. Authorised use of nets—(1) No person shall use or cause to be used for any purpose a net of any description, except as provided for in clause 4 of this notice, except:

(a) A whitebait net;

(b) any net used for taking fish for the purpose of management or scientific investigations pursuant to an authority granted pursuant to section 72 of the Act.

provided that it shall be a defence for any person charged with a breach of this notice if he proves that he was netting for indigenous fish in accordance with the provisions of any regulations or notices in that behalf for the time being in force.

  1. Prohibition on possession or control of spear gun—(1) No person shall, when taking any acclimatised fish or when in possession of any acclimatised fish, have in his possession or under his control any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.

(2) Where any person is charged with an offence under sub-paragraph (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in his possession or under his control was not used in taking the acclimatised fish.

(3) In this clause the term “explosive” has the same meaning as in the Explosives Act 1937.

  1. No disturbance or possession—No person shall otherwise than in accordance with this notice intentionally disturb or damage the spawning redds or the eggs or larvae of acclimatised fish or have in his possession the eggs or larvae of acclimatised fish.

  2. Authorised lures and baits—No person shall fish for acclimatised fish with any bait or lures other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca) ) or uncoloured bread dough.

  3. Authorised fishing gear—(1) No person when fishing for acclimatised fish shall use—

(a) more than 2 lures or baits;

(b) any lead or weight attached below or so as to hang below any lure or bait;

(c) in any water in which only artificial fly is permitted, any lead or weight other than the necessary weight of line, cast and fly,
