Before the Broadcasting Tribunal

IN the matter of the Broadcasting Act 1976, and in the matter of an application by RADIO RHEMA INCORPORATED for amendment of sound radio warrant 3XG:

DECISION

The applicant holds a sound radio warrant to operate a non-commercial radio station in Christchurch.

The applicant sought to amend the warrant to provide for a further relay station at Nelson with a maximum power of 1 kilowatt to broadcast during the hours of 0600-2400 daily. These are the hours which the station broadcasts in Christchurch and Wellington.

The application was based on the applicant’s experience during a short-term broadcast for 25 days from 16 April to 10 May 1981, audience surveys carried out at that time, public reaction to that broadcast, and the committed response to the station shown by the membership of the applicant in the area.

The applicant said it would provide for the need for pleasant carefully chosen music and informative programmes free of commercial advertising pressure, the need for promotion of community projects and ideals without commercial connections, the need for children’s programmes without commercial associations and which do not ignore spiritual values. It would fill the need for a station which has a policy of promoting personal development, hope and other such positive values, the need for material which provides spiritual assurance and comfort in times of stress or loneliness, a general desire of people to hear a greater variety of material of a spiritual nature and the need for a telephone counselling ministry operated in conjunction with a visible public medium.

The applicant said the New Zealand content of the programming would be 47 percent and a news service provided by the Christchurch station would include items provided by a Nelson news-room.

The applicant proposed to broadcast on a frequency of 801 kHz at a power output of 1 kilowatt. The Broadcasting Corporation of New Zealand did not oppose the grant of the application but raised questions as to power of the station and the frequency on which it should broadcast.

The Tribunal has considered the evidence and the submissions made by both the applicant and the Corporation.

The Tribunal considers that a case has been made for the grant of the relay station and is satisfied that the service would be desirable in the public interest. In considering this the Tribunal has considered both the programme content and the support evidenced for the programme by the membership of Radio Rhema in the area which is nearly 1.8 percent of the population.

The Tribunal does not consider that the station will have any significant economic effect on the existing commercial station in the area or on the broadcasting services provided by the Corporation in the public interest.

The Tribunal accepts that there is some public desire for services of the kind provided by the station. It is clear from the Christchurch station’s Wellington relay that Radio Rhema can capture a small but clearly discernible audience. It may prove to be a larger proportion in this market than in the more competitive radio markets of Christchurch and Wellington.

The Tribunal is satisfied that the applicant has the financial ability to carry on the proposed service. Past experience has shown that the applicant will carry on the service satisfactorily.

In view of our conclusions we do not need to traverse the survey material.

The main issue to be determined was the allocation of frequency. The Tribunal was concerned that this particular frequency may be needed for some other purpose and explored the possibilities with the Post Office and BCNZ witnesses of an alternative choice of frequency. It was clear that there were no current plans for the use of this frequency and that although there are other frequencies which could be certified for this station, the Tribunal prefers to approve the use of the frequency 801 kHz although it must be understood by the applicant that for the best use of the available spectrum the frequency may have to be changed in the future.

The BCNZ considered that further time should be taken for research and produced a plan for consideration by Radio Rhema for use in planning for the future. We believe that there is much value in such thinking and planning being carried out but consider in the present instance that until further research shows that there are satisfactory alternatives which will provide a reasonable coverage to the proposed audience to be served in this area, the Tribunal should approve the use of 801 kHz.

The warrant will be amended to show the following conditions:
The warrant holder shall operate—

(a) A relay station at Wellington, during the hours 0600-2400, with a maximum power of 5 kW on the frequency of 1503 kHz; and

(b) A relay station at Nelson, during the hours 0600-2400, with a maximum power of 1 kW on the frequency of 801 kHz; and
