Declaring Land to be Road, Road Stopped and Land Taken in Block II, Opaheke Survey District, Franklin County

PURSUANT TO Part VIII of the Public Works Act 1981, the Minister of Works and Development—
(a) Pursuant to section 114, declares the land described in the First Schedule to be road, and vested in The Franklin County Council;
(b) Pursuant to section 116; the portion of road described in the Second Schedule to be stopped.
(c) Declares the land described in the Third Schedule to be taken under section 119 (1), and declares that the land shall, when so taken, vest in The Franklin County Council.

FIRST SCHEDULE
NORTH AUCKLAND LAND DISTRICT
Land Declared to be Road

ALL those pieces of land, situated in Block II, Opaheke Survey District, described as follows:

Land Acquired for Road and Road Stopped in Block II, Apiti Survey District, Kiwitea County

PURSUANT to the Public Works Act 1981, the Minister of Works and Development—
(a) Pursuant to section 20, declares that an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for road and shall vest in the Kiwitea County Council on the 4th day of August 1983.
(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second Schedule hereto to be stopped, and declares that—
(i) The areas “JA” and “N” on S.O. Plan 32736 shall be amalgamated with the land in certificate of title, Volume 75, folio 172, subject to memoranda of mortgage Nos. 299474.2, 894056, 062864.1 and 271674.3 and statutory land charge No. 124650.1.
(ii) The areas marked “O” on S.O. Plan 32735, “JB” on S.O. Plan 32736 and “A”, “E” and “G” on S.O. Plan 32737 shall be amalgamated with the land in certificate of title, Volume 105, folio 8, subject to memorandum of mortgage No. 661820.

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for road and shall vest in The Waimea County Council on the 4th day of August 1983.
