both basic and availability charges may be adjusted annually to take into account of variations between the estimated and actual construction costs, variations between estimated and actual costs for operation, maintenance and renewals, and variations in quantity of water or subject to availability agreements.

  1. The charges payable shall be for a period of 20 consecutive seasons commencing at the start of the first year of supply for the scheme as determined and notified according to section 217 of the Act.

  2. The supply of water will be subject to the water right granted by the Bay of Plenty Regional Water Board. This right (No. 1021) is for 3000 m³/day (3 thousand cubic metres per day) of water to be taken from the Wairoa River adjacent to the Waireia Stream mouth.

FIRST SCHEDULE
WATER SUPPLY WORKS

THE Tebbutt Road Area Irrigation Works by which means water can be drawn from the Wairoa River by a piped water supply to a storage reservoir from which point the said water will be either gravity or pump reticulated to each property through a control valve as appropriate to enable trickle irrigation for horticultural plantings.

The said works include all reservoirs, electrical supply equipment, piping, gauges, boxes, valves, pumps, filters, meters, and all other works incidental to or required for the construction, maintenance and control of the said works for the irrigation of the district.

At the Government House at Wellington this 25th day of July 1983

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 138 (1) (b) of the Public Works Act 1981, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares

that the land described in the First Schedule hereto shall, on and after the date of publication of this Order in Council in the Gazette, be a motorway, and further, pursuant to section 138 (2) of the Public Works Act 1981, hereby revokes the Order in Council dated the 13th day of December 1982, published in the Gazette of 27 January 1983, No. 5, at page 157, declaring land to be a motorway in the City of Auckland, insofar as it affects the land described in the Second Schedule hereto.

NORTH AUCKLAND LAND DISTRICT
Land Declared to be Motorway

ALL that portion of public highway in the City of Auckland being those traffic lanes, shoulders and verges connecting with the Auckland-Kumeu Motorway at Western Springs and thence proceeding generally westwards for a distance of approximately one kilometre and connecting with the Auckland-Kumeu Motorway at a location south of the junction of Motions Road and the Great North Road, and including the on and off ramps at Western Springs and the crossing under St Lukes Road; coloured red on the plan.

SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
Motorway Status Revoked

ALL that portion of motorway in the City of Auckland being those traffic lanes, shoulders and verges commencing at the southern side of the Great North Road, approximately 150 metres east of the junction with Motions Road and proceeding in a south-westerly direction for a distance of approximately 100 metres; coloured green on plan.

As shown on Plan 1/82/18/3124/1/R1, deposited in the office of the Minister of Works and Development at Wellington, and thereon coloured as above mentioned.

PURSUANT to section 4 of the Disabled Persons Employment Promotion Act 1960, His Excellency the Governor-General, acting on the recommendation of the Minister of Labour made after consultation with the unions, associations, and organisations referred to in section 5 of that Act, and by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title—This order may be cited as The New Zealand Society for the Intellectually Handicapped (Incorporated), Franklin Branch Order 1983.

  2. Exemption—The New Zealand Society for the Intellectually Handicapped (Incorporated), Franklin Branch, an organisation approved* by the Minister of Labour under section 3 of the Disabled Persons Employment Promotion Act 1960, is hereby granted exemption in respect of its sheltered workshop at 105 Edinburgh Street, Pukekohe from—

(a) All the provisions of every award and agreement that would otherwise apply to persons employed in that workshop; and

(b) The Minimum Wage Act 1945, the Holidays Act 1981, and sections 10 (2) (b) and 15 of the Factories and Commercial Premises Act 1981.
