NOTICE OF APPLICATION TO THE HIGH COURT OF NEW ZEALAND

UNDER PART III OF THE CHARITABLE TRUSTS ACT 1957

By Wellington Presbyterian Social Service Association as Trustee of the Ann Sinclair Home Trust

PUBLIC notice is hereby given that Wellington Presbyterian Social Service Association (“the Trustee”) has applied for consent to a Scheme under Part III of the Charitable Trusts Act 1957—

(1) Varying the trusts, and
(2) Extending the powers of the Trustee in respect of a trust created by the late Ann Sinclair of Pirinoa, spinster by deed.

The Trustee presently holds farm land in the Wairarapa and proposes to sell the property thereby creating a Trust Fund for purposes which are summarised as follows:

Assisting boys with travel to, accommodation and education in various aspects of farming at suitable educational institutes. The boys to be assisted will be primarily those in need and likely to benefit from training for farming. After fulfilling the primary assistance purpose funds can be applied for training other boys in farming as the Trustee sees fit. Further the Trustee will be able to provide funds for farm training institutions and to establish conduct or provide assistance for camps for Bible Classes, Youth Groups, Childrens Homes, and other organised Christian bodies for holidays or retreats.

The existing trust requires that the Trustee hold the farm property for the purpose of a Boys Home and farm training establishment for boys and for the purpose of providing camps as mentioned above. The Trustee has prepared the Scheme because it believes that it is now impracticable and inexpedient to carry out the terms of the trusts in respect of the Ann Sinclair Home and the Trust Deed establishing same.

The Trustee has incorporated further and more extensive powers of management of the Trust Fund in the Scheme and requested consent to same because the powers in the original Trust Deed are restrictive and not conducive to proper management of the trust in its proposed new form.

The Scheme is available for perusal during office hours at the Registry Office of the High Court at Wellington or at the offices of the Solicitors for the Trustee, Messrs Young Swan Morison McKay, Ninth Floor, Challenge House, 105–109 The Terrace, Wellington.

The application for approval of the Scheme and for an order that the costs of the Trustee and the Attorney-General be paid from the Trust Fund is to be heard in the High Court at Wellington on the 2nd day of March 1983 at 10 o'clock in the forenoon.

Any person desiring to oppose the Scheme must give written notice of his intention so to do to the Registrar of the High Court at Wellington and to the Trustee and to the Attorney-General not less than 7 days before the aforesaid date for hearing.

The address of the Trustee for service for notices is at the offices of Messrs Young Swan Morison McKay, at the above-mentioned address.

Printed without textual alteration, the work provides an important basis for any study of old-time Maori economics and perhaps more importantly of his attitude to what was a major part of his environment. It will be of more general interest today than when first written, since it stresses so fully the uses made by the Maori people of their natural resources, and supplies basic materials for further studies in ethnobotany and ethnology. The reverence which the old time Maori showed towards natural resources mirrors the modern concern for ecological principles.
