Crown Land Set Apart for Ministry of Works and Development Staff Housing in the Borough of Raetihi

PURSUANT to section 52 of the Public Works Act 1981, the Minister of Works and Development declares the land described in the Schedule hereto to be set apart for Ministry of Works and Development staff housing.

ALL that piece of land containing 1012 square metres, situated in Block VI, Makotuku Survey District, being Section 217, Town at Raetihi.

PURSUANT to sections 20 and 50 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for a sewage pumping station, and shall vest in The Kapiti Borough Council on the 15th day of July 1982.

Stormwater Drainage Easement Acquired for a Police Station in the Borough of Otahuhu

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, a stormwater drainage easement over the land described in the Second Schedule hereto, vesting in the Crown the rights contained in paragraph 3 of the Seventh Schedule to the Land Transfer Act 1952, is hereby acquired, subject to the conditions described in the First Schedule hereto, for a police station on the 15th day of July 1982.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Conditions of Easement

  1. That the standard of construction of the line of pipes within the easement area shall comply with the Otahuhu Borough Council’s Bylaws in that respect and in all other respects as if the drain was a public drain under the control and administration by the aforesaid council as a public drain.

  2. That the Crown shall be responsible for all installation and maintenance costs of the line of pipes within the easement area and shall restore the property to its original condition and pay the full costs thereof.

  3. That the responsibility for the maintenance of the section of the drain to be situated on the land described in the Second Schedule hereto, shall be the responsibility of the Crown. Should the aforesaid section of drain be declared a public drain under the control and administration of the Otahuhu Borough Council, the Crown shall no longer be liable for any share of the maintenance costs.

  4. That no permanent structures shall be built over the easement area.


SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Land Over Which Easement is Acquired

ALL that piece of land containing 68 square metres, situated in the Borough of Otahuhu, and being part Lot 1, D.P. 81034; as shown marked “A” on S.O. Plan 56276, lodged in the office of the Chief Surveyor at Auckland.
