62.9 Goods at the risk of the owner
Goods remaining on hand in excess of the delivery times specified in the Carriage of Goods Act 1979, as set out in clause 20, shall be held at the risk of the owner.
62.10 Notice to consignee
Whenever goods are stored, notice will be given to the consignee wherever possible to the address shown on the goods or on papers relating thereto, but the omission to give such notice shall not affect the liability of the Corporation in respect of such goods, or its right to charge for the storage of the goods.
62.11 Storage services
The Corporation does not undertake the provision of storage accommodation for goods.
- DEMURRAGE
63.1 When demurrage charged
63.1.1 Undischarged wagons: On each wagon loaded with goods which it is the duty of the consignee to unload, and which is not completely discharged within eight working hours from the time that the wagon is available for unloading.
63.1.2 Delayed dispatch: On each wagon ordered and not loaded, or improperly loaded, or loaded and not ready for dispatch within eight working hours from the time such wagon is made available for loading.
63.2 Working hours
For the purposes of calculating demurrage charges “working hours” and holidays shall be as provided in clause 20.15.
63.3 Duty to unload
For the purpose of clause 63.1.1 it shall be deemed to be the duty of the consignee to unload goods in the following instances:
63.3.1 Wherever it is specifically provided “owners to unload” or words to that effect; and
63.3.2 Where goods, irrespective of classification are put off at a station or siding where there is no stationmaster in charge; or placed in a private siding; and
63.3.3 When goods, irrespective of classification are consigned in wagon lots from one consignor to one consignee; and
63.3.4 In all cases other than where storage charges apply in terms of clause 62.
63.4 Liability
Goods which in terms of clause 63.3 it is the duty of the consignee to unload, on hand awaiting delivery, shall be held at the owner’s risk after eight working hours from the time when the wagon is available for unloading.
63.5 Charges for demurrage
Demurrage shall be charged as follows:
63.5.1 Four wheeled wagons: $50.00 per wagon for each succeeding eight working hours or part thereof.
63.5.2 Bogie wagons: $100.00 per wagon for each succeeding eight working hours or part thereof.
63.6 Privately owned containers
Wagons containing privately owned containers (including import/export containers and “Seafreighters”) shall be charged demurrage irrespective of whether such containers are empty or loaded.
63.7 Corporation may unload
The Corporation reserves the right to unload wagons on hand in excess of eight working hours from the time that the goods are available for delivery, at the sole risk and expense of the owner or consignee.
