In the matter of the Charitable Trusts Act 1957, and in the matter of the Leys Institute Building and Library Endowment Trust:
Notice is hereby given that Geoffrey Thomson Upton and Thomson Hilton Leys, both of Auckland, company directors (hereinafter called "the Trustees"), have filed in the High Court at Auckland a motion for an order approving a scheme under the provisions of the Charitable Trusts Act 1957, for the future administration and application of the capital and income of certain trust property held by them. The scheme relates to a gift made by the late Sir William Cecil Leys by a deed bearing date the 6th day of June 1945, to provide an addition to the buildings of the Leys Institute in St. Mary's Road, Ponsonby, and to provide a supplement to the income of the Director of the Leys Institute. The buildings have been fully provided and the continuing income is more than sufficient for the remaining purposes of the gift.
If the scheme is approved by a Judge of the High Court of New Zealand, the income from the trust will thereafter be held by the trustees not only for its original purposes, but also for enlarged and additional purposes for the enhancement of the library at the Leys Institute and for the assistance in the education (particularly with regard to illiteracy and reading difficulties) of persons in the Ponsonby area, and otherwise upon the trusts and in accordance with the provisions more particularly set out in the said scheme.
Notice is also given that the motion is to be heard at the High Court at Auckland on Friday, the 9th day of July 1982, at 10 o'clock in the forenoon; and that any person desiring to oppose the scheme is hereby required to give written notice of his intention so to do to the Registrar of the High Court at Auckland and to the trustees at the offices of their solicitors undermentioned and to the Attorney-General (at the Crown Law Office, Waring Taylor Street, Wellington), not less than 7 clear days before the said date of hearing.
