Land Acquired Subject to Mining Rights, for Purposes Incidental to Coal Mining Operations under Part IV of the Coal Mines Act 1979, in the Borough of Huntly

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired, subject to the mining rights reserved in Transfer 247358, and the mining rights created in favour of the Taupiri Coal Mines Limited in Lease 2629, South Auckland Land Registry, for purposes incidental to coal mining operations under Part IV of the Coal Mines Act 1979 on the 25th day of March 1982.

Declaring Easements Over Land Acquired for Waterworks in Block VIII, Thames Survey District, Thames-Coromandel District

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, agreements to that effect having been entered into, the water supply easement firstly described in the First Schedule hereto is hereby acquired for waterworks over the land described in the Second Schedule hereto, and the electrical supply easement secondly described in the Third Schedule hereto is also hereby acquired for waterworks over the land described in the said Second Schedule, and the right of way easement described in the Third Schedule hereto is hereby acquired for waterworks over the land described in the Fourth Schedule hereto and that the said easements shall vest in The Thames-Coromandel District Council on the 25th day of March 1982.

FIRST SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Description of Easements

THE full and free right, liberty, authority and licence in perpetuity for The Thames-Coromandel District Council (hereinafter called “the Council”), its agents, servants, workmen, employees, contractors and any other person lawfully entitled thereto from time to time and at all times to:

1. Lay, construct, place, remove, reconstruct, cleanse, repair and maintain a water pipeline main and pumphouse under, along, and over the land described in the Second Schedule hereto and to convey water in unimpeded flow through the said pipeline main and pumphouse, and

2. Lay, construct, place, remove, reconstruct, cleanse, repair, maintain an electrical cable and main under, along, and over the land described in the Second Schedule hereto, and to convey electricity in an unimpeded flow through the said cable and main, and for such purposes by the Council, its agents, servants, workmen, employees and contractors to enter upon and to pass and repass over the land described in the said Second Schedule with or without horses and vehicles, laden or unladen, and materials, machinery and implements to make on the land described in the said Second Schedule any cuttings, fillings, grades, batters, or trenches and to reopen any such trenches and to lay, construct, place, remove, reconstruct, cleanse, repair or maintain any waterpipes, mains, pumphouse, electrical cables and mains or lay, lift, repair and relay additional pipes, cables and mains and do all and singular, upon or under the land described in the Second Schedule hereto such acts, deeds, matters, or things as the Council, its agents, servants, workmen, employees, or contractors may consider necessary or desirable for or in anywise in connection with the laying, constructing, placing, removing, reconstructing, cleansing, repairing, and maintaining or use of such waterpipes and mains pumphouse and electrical cables and mains and the transmission of water and electricity along, and over the land described in the said Second Schedule.
