Declaring Easements Over Land Acquired for a Water Race in the Borough of Dannevirke
PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, an easement in gross is hereby acquired for a water race, vesting in the Dannevirke Borough Council (called the grantee), the right to convey water across the land described in the Schedule hereto, such grant being in accordance with paragraph 2 of the Seventh Schedule to the Land Transfer Act 1952, together with the additional rights contained in paragraph 5 of the said Seventh Schedule provided that (1) the grantee will keep and maintain at its own cost the pipeline or pipelines in good and serviceable repair and shall not nor will allow the same to fail into disrepair nor do damage of any kind nor become a nuisance by bursting, leakage or other cause whatsoever and shall take all necessary steps to protect persons and stock from injury; (2) the grantee will at all times hereafter during the existence of this grant indemnify and save harmless the owners of the said land from and against all claims, charges or proceedings that may in any way arise out of or be referable to the existence of the grant or the exercise of the rights hereby conferred on the grantee; (3) if in the construction of the pipeline or pipelines or in the maintenance thereof the grantee is required to dig up the pasture or dismantle any fences or gates upon the said land or if by constructing the said pipeline or pipelines or in maintaining the same the grantee damages or disturbs any of the improvements upon the said land then and in any such case the grantee shall restore the pasture, fences, gates or other improvements to the same good condition that they were formerly in; (4) all legal and survey costs of and incidental to this agreement and to the taking of the grant under the Public Works Act 1981 and all other expenses whatsoever of
