NOTICE is hereby given that a petition for orders:
- That the High Court do order that ALBERT GUBAY or the company purchase the shares of the petitioner in the company at a price to be fixed by arbitration in accordance with the provisions of the Arbitration Act 1908 and its amendments, such arbitration to be at the expense of the said ALBERT GUBAY or of the company in all respects and in the case of the purchase of shares by the company for the reduction of the company’s capital accordingly.
- That the said ALBERT GUBAY or the company do pay the costs of and incidental to the petition and any order thereon.
- Such other order may be made in the premises as should be just; was presented to the High Court on the 19th day of November 1982, by REGINALD ERNEST WEST of Auckland, company manager, and that the said petition is directed to be heard before the Court sitting at Auckland on the 2nd day of February 1983, at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.
