THE CHARITABLE TRUSTS ACT 1957

NOTICE OF APPLICATION FOR APPROVAL OF A SCHEME UNDER PART III OF THE CHARITABLE TRUSTS ACT 1957

NOTICE is hereby given that the General Trust Board of the Diocese of Auckland has filed in the office of the High Court at Auckland, an application for approval of a scheme by which the H. M. Smyth Trust created by the will of the late Henry Montague Smith, who died on the 25th day of June 1948, having a current value of $41,949.15, and the proceeds of the St. Peter’s Endowment Fund set up by Bishop Selwyn in 1850, having a current value of $3,860.00, be varied to enable the capital and income therefrom to be used for the purposes of building alterations and extension work to the existing St. Peter’s Church, at Onchunga in lieu of the present trusts upon the grounds:

(a) It is inexpedient to complete the Church at St. Peters in a Gothic style in accordance with the original plans as required by the H. M. Smyth Trust, and the amount available is inadequate to carry out that purpose;

(b) The St. Peter’s Endowment Fund is inadequate to be a useful endowment.

Copies of the scheme and the report of the Attorney-General thereon may be inspected free of charge at the office of the Registrar of the Supreme Court, Auckland, and at the offices of Messrs Hesketh and Richmond, Solicitors, Seventh Floor, Norwich Union Building, Queen Street, Auckland, 1.

The date proposed for the hearing of the application is the 26th day of June 1981. Any person desiring to oppose the scheme is hereby required to give written notice of his intention to the Registrar of the High Court at Auckland, and to the General Trust Board at the offices of Messrs Hesketh and Richmond, and to the Attorney-General, not less than 7 clear days before that date.
