Declaring an Easement in Gross Over Land Taken for Flood Protection Purposes in the City of Lower Hutt

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, an easement in gross is hereby taken for flood protection purposes over the land described in the Schedule hereto, vesting in the Lower Hutt City Council the full and free rights, liberties and licences and privileges in perpetuity hereinafter set forth, that is to say:

(a) The right for the Council by its servants, agents, workmen and invitees, and by all other persons duly authorised by the Council from time to time and at all times by day and by night and with or without vehicles and implements of all description, loaded or unloaded, to enter and remain upon that part of the land described in the Schedule hereto.

(b) The right to construct and maintain the protective work upon the easement area and to reconstruct, repair, alter, reduce, enlarge, or renew the said protective work as the Council may from time to time deem expedient.

(c) The right to, generally upon the easement area, without hereby imposing an obligation upon the Council so to do, perform and execute all Acts and things as may be necessary or proper for any of the purposes hereinbefore referred to and in the carrying out of any such purposes and in keeping the protective work in a good and sufficient state of repair for the purposes for which the same is designed and preventing the same from becoming a nuisance, doing as little damage to the surface of the easement area as possible and restoring the same to its former state and condition and repairing and making good all damage to fences, gates or drains in, upon or around the easement area caused by the carrying out by the Council of any of the works hereinbefore mentioned and removing if required by the owner any silt or other material from time to time taken from the protective work for the purpose of its maintenance, from and after the 2nd day of April 1981.

WELLINGTON LAND DISTRICT
ALL that piece of land containing 872 square metres, situated in Block XIV, Belmont Survey District, City of Lower Hutt, being part Lot 7, on D.P. 8231, and part Lot 2, on D.P. 8232; as shown on plan S.O. 26926, lodged in the office of the Chief Surveyor at Wellington, and thereon coloured blue.
