Notice To Capture Marine Mammal

PURSUANT to section 5 (5) of the Marine Mammals Protection Act 1978, the Minister of Fisheries advises that the Hawke’s Bay Marineland has applied for a permit to capture one dolphin for breeding and display purposes and hereby calls for any submissions regarding this application to be made in writing within 28 days of publication of this notice.

Notice No. 1, 1981
PURSUANT to the Transport Act 1962, the Minister of Transport hereby gives the following notice.
NOTICE
This notice may be cited as the Traffic (Masterton Borough and Masterton County) Notice No. 1, 1981.
The roads specified in the First Schedule hereto are hereby declared to be closely populated localities for the purposes of section 52 of the Transport Act 1962.
The roads specified in the Second Schedule hereto are hereby excluded from the limitation as to speed imposed by section 52 of the Transport Act 1962.
The roads specified in the Third Schedule hereto are hereby declared to be 70 kilometres an hour speed limit areas pursuant to regulation 21 (2) of the Traffic Regulations 1976*.
The Traffic (Masterton Borough) Notice No. 1, 1976, dated the 30th day of November 1976† issued pursuant to section 52 of the Transport Act 1962, and regulation 27A of the Traffic Regulations 1956 is hereby revoked.
FIRST SCHEDULE
SITUATED within Masterton County adjacent to Masterton Borough:
Green Lane Road.
Upper Plain Road: from the Masterton Borough boundary to a point 100 metres measured north-westerly, generally, along the said road from the said boundary.
SECOND SCHEDULE
SITUATED within Masterton Borough:
No. 2 State Highway (Pokeno-Wellington via Gisborne): from a point 320 metres measured westerly, generally, along the said State Highway from South Belt Road to the south-western boundary of Masterton Borough.
Gordon Street: from the northern boundary of Masterton Borough to a point 120 metres measured south-westerly, generally, along the said street from Kitchener Street.
Manaia-Gladstone Road.
Ngaumutawa Road: from a point 320 metres measured north-easterly, generally, along the said road from Renall Street to Akura Road.

Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publication:
Kama Sutra, published by Howard Productions Pty. Ltd.

Decision
A sample copy of Kama Sutra was imported commercially by parcel post and seized at Auckland in September 1980. As the importer has disputed forfeiture the Customs Department has referred the publication to the Tribunal for classification prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966.
Mr Leloir has contended that the publication is a cheap, abridged version of the original classic version translated by Sir Richard Burton. He states that many of the pictures do not appear to relate to the text and appear to be designed merely to assist the commercial exploitation of the text by means which are indecent.
The Waverley Publishing Co. made a short written submission in which they suggest that an age restriction would be appropriate.
Kama Sutra is a paperback publication, based on the original classic translated by Sir Richard Burton. Samples of the writings have been selected, to depict various techniques of achieving sexual pleasure, used in conjunction with a series of photographs, to give an impression that the publication is an accurate precis of the original classic. In fact this has not been achieved.
In 1976, in Decision No. 863, the Tribunal ruled on a similar edition, that although the Kama Sutra itself is not indecent, the particular edition under consideration was indecent. In view of the nature of the publication, there is a distinct lack of honesty of purpose.
Accordingly, we consider that the present edition should be similarly classified, and rule that this particular publication of the Kama Sutra is indecent.
