SECOND SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Description of Easement

To give the Hamilton City Council the full and free right and authority from time to time and at all times hereafter:

(a) To construct and install open drains and/or drainage pipes or conduits through, over, and under the said land, and to discharge, convey, and drain into and through such open drains and/or drainage pipes or conduits all water whether rain, tempest, spring, surface, seepage water, or water from any stream or river in any quantities from the city of Hamilton and/or neighbouring localities.

(b) To repair, alter, construct, or maintain all such open drains and/or pipes or conduits including any manholes, valves, or surface boxes as may be constructed, laid down or erected in or under the said land in a good and sufficient state of repair.

(c) To enter upon the said land upon the purposes of taking therefrom any earth, clay, stone, boulders, gravel, sand, or other material thereon for the purposes of giving effect to the easement thereunder and not as a profit a prendre.

(d) To enter on the said land at all times by day or by night by the Council’s engineers, officers, agents, and workmen and with or without vehicles and machinery loaded or unloaded to pass through or over the said land for the purposes of constructing, reconstructing, altering, repairing, and maintaining the drain, and generally to do and perform all such acts and things in or upon the said land as may be necessary or proper for or in relation to any of the purposes aforesaid.

(e) To plant, sow, and maintain trees, shrubs, plants, or grasses on the said land.

(f) To dig and excavate the soil in the said land to such extent and depth as the Council shall deem to be necessary for the purpose of carrying out or performing any of the provisions of the said easement.

Land Over Which Drainage Easement is Taken

Declaring Land and an Easement Over Land Taken for a Place of Public Recreation or Enjoyment for the Benefit of the Inhabitants of Two or More Local Districts in Blocks II and III, Opaheke Survey District, Franklin County

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for a place of public recreation or enjoyment for the benefit of the inhabitants of two or more local districts and shall vest in the Auckland Regional Authority, and a right of way easement appurtenant to the land described in the said First Schedule is hereby taken over the land described in the Second Schedule hereto for a place of public recreation or enjoyment for the benefit of the inhabitants of two or more local districts, vesting in the Auckland Regional Authority, its servants, agents, and workmen, the full, free, and uninterrupted right, liberty, and licence at all times to pass and repass with or without stock or vehicles of any description over and along the land described in the said Second Schedule, from and after the 5th day of March 1981.

FIRST SCHEDULE
