PURSUANT to section 175 (3) and subject to sections 176 to 182 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Hokianga County Council to reclaim from the bed of the Tapuwae River, Hokianga Harbour, an area of 840 square metres, more or less, as shown on plan M.D. 16048 and deposited in the office of the Ministry of Transport in Wellington.

Franklin County - Papakura City Boundary Alteration Order 1981

ORDER IN COUNCIL

THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

ORDER

1. Title and commencement—(1) This order may be cited as the Franklin County-Papakura City Boundary Alteration Order 1981.
   (2) This order shall come into effect on the 1st day of April 1981.

2. Boundaries of Franklin County and Papakura City Altered—(1) The boundaries of the County of Franklin and the City of Papakura shall be altered by excluding from the district of the County of Franklin and including in the district of the City of Papakura the areas described in the First Schedule to this order.
   (2) The boundaries of the City of Papakura and the County of Franklin shall be altered by excluding from the district of the City of Papakura and including in the district of the County of Franklin the area described in the Second Schedule to this order.

3. Effect on Riding—The area of land described in the Second Schedule to this scheme shall form part of the Drury Riding in the County of Franklin.

4. Transitional Provisions—The Papakura City Council, in respect of the areas of land described in the First Schedule to this order, and the Franklin County Council in respect of the area of land described in the Second Schedule to this order:
   (a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which would have been so exercised, by the territorial authority from whose district the area is hereby excluded;
   (b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the territorial authority from whose district the area is hereby excluded;
   (c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the territorial authority from whose district the area is hereby excluded;
   (d) Shall succeed to the bylaws which are in force and which are applicable to the authority’s altered circumstances and, until revoked or altered by such authority, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the area by the alteration of boundaries;
