  1. Notice is hereby given that the Examiner of Commercial Practices has reported to the Commerce Commission on a takeover proposal notified to him in terms of section 68 of the Act. This proposal concerns the acquisition by Ballins Industries Limited of all the liquor interests of Dalgety New Zealand Limited except those situated at Wairoa and Jetty Point (Dunedin). The examiner, in his report, expresses the view that certain aspects of the proposed takeover will have effects contrary to the public interest. His report concludes with the following recommendations:

“(i) I recommend that the commission decline to consent to the proposal whereby Ballins would acquire all the wine and spirits interests of Dalgety except those situated at Wairoa and Jetty Point (Dunedin).

“(ii) I recommend that, pursuant to the commission’s powers under section 78 (4) of the Act, the commission consent to the acquisition by Ballins of the wine and spirits businesses of Dalgety situated at Thames, Napier, Wanganui, Levin, Nelson, Dunedin (Anderson Bay Road) and Rotorua (licence only).

“(iii) As I am in doubt concerning the effect on the public interest of the acquisition by Ballins of Philips and Pike, I have no recommendations to make.”

  1. Notice is hereby further given that the commission will conduct a public inquiry into this matter commencing at 10.30 a.m. on 7 December 1981 at its offices, Sixth Floor, Chase NBA House, 163 The Terrace, Wellington.

  2. Notice is hereby further given that section 14 of the Act provides that certain persons or organisations (who may be affected by or who could assist the commission in its inquiry into this matter) may, with the commission’s consent, be admitted as parties to this hearing.

  3. Notice is hereby further given that anyone wishing to take part in this inquiry pursuant to paragraph 3 above is asked to apply in writing and with reasons to the commission, whose postal address is P.O. Box 10273, Wellington, by 16 November 1981.

  4. Notice is hereby further given that a preliminary hearing to consider applications received in terms of paragraph 4 above will be held on Thursday, 19 November 1981, commencing at 10.30 a.m., at the address specified in paragraph 2 above.
