Declaring an Easement Over Land Taken for Soil Conservation and River Control Purposes in Blocks III and VII, Rangiriri Survey District, Waikato County

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that a sufficient agreement to that effect having been entered into, the easement described in the First Schedule hereto is hereby taken for soil conservation and river control purposes over the land described in the Second Schedule hereto, from and after the 10th day of September 1981.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

Description of Easement

THE full and free right, liberty, licence and authority in perpetuity for Her Majesty The Queen (hereinafter called “the grantee”), her engineers, officers, agents and workmen to do and carry out the following on the land described in the Second Schedule hereto:

  1. To enter on the said land, to go, pass and repass, with or without machinery or vehicles over and along the said land.

  2. To delegate to the Waikato Valley Authority or to the local council as defined by the Waikato Valley Authority Act 1956, the rights and powers conferred by this grant.

  3. To construct a stopbank or stopbanks or other defence against water of such dimensions as the grantee shall determine, and from time to time to alter or reconstruct the same, and do all things which are necessary to maintain the same in a state of efficiency.

  4. To plant, sow and maintain trees, shrubs, plants, or grasses on the said land and to regulate or prohibit interference with or the destruction thereof.

  5. To prohibit or regulate access to or the passing over or along any bank, dam, or other defence against water, or other work of any kind whatsoever constructed or maintained by or under the control of the grantee on the said land.

  6. To prohibit the planting of willows or other trees on the said land.

  7. To prohibit the lighting of fires on the said land, except under such circumstances and subject to such limitations, conditions and restrictions as may be prescribed by the grantee.

  8. Generally to require the doing on or in respect of the said land of any act or thing which may be likely to prevent or mitigate soil erosion or promote soil conservation or the control of floods, and to prohibit the doing on or in respect of the said land of any act or thing which may be likely to facilitate soil erosion or floods.

  9. This easement does not preclude the owners from future building development within that area bounded by the stopbank and State Highway 1 providing the design of any such building has the prior approval in writing of the Waikato Valley Authority.


SECOND SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

Land Over Which Easement is Taken

Agreement for Grant of Right of Way in Favour of Kimihia Farms Limited Over Land in the Borough of Huntly, Taken for the Generation of Electricity, Assented to

WHEREAS, by a proclamation dated the 9th day of November 1973, and published in New Zealand Gazette, 15th November 1973, No. 105, page 2347, all those pieces of land situated in the Borough of Huntly, containing together 118 acres and 39.2 perches; being Lot 1, D.P. 35484, Lots 3 and 5, D.P. 21337, Lots 32 to 38 (inclusive), D.P. 23553 and part Lot 4, D.P. 21337, and being all of the land described in certificates of title, Volume 929, folio 120, Volume 606, folio 164, Volume 653, folio 212, Volume 827, folio 134, Volume 1269, folio 56, South Auckland Land Registry, were taken for the generation of electricity;

And whereas by a declaration dated the 8th day of July 1977 and published in New Zealand Gazette, 29 September 1977, No. 101, page 2581, all those pieces of land containing together 7.0466 hectares, situated in the Borough of Huntly, being parts Lot 2, D.P. 21337, and being part Allotments 9 and 10, Parish of Taupiri, and being parts of the land described in certificate of title, Volume 1269, folio 57, South Auckland Land Registry, were taken for the generation of electricity;

And whereas Kimihia Farms Limited was entitled to compensation in respect of the taking of the said land;

And whereas the Minister of Works and Development has agreed to grant to the said Kimihia Farms Limited a right of way over all those pieces of land being part Lot 241, D.P. S. 25265, and part Lot 242, D.P. S. 25265, as shown on Deposited Plan S. 25265, lodged in the Land Registry Office at Hamilton, and thereon marked “A” and “B” respectively;

And whereas the said Kimihia Farms Limited has agreed to accept such grant of right of way in part satisfaction of the said compensation:

Now therefore, the Minister of Works and Development hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.
