Having considered each of these issues and the submissions made and having regard to all the matters which the Tribunal has to take into account under the Act there is, in its view, no reason to alter the classification previously made.

The Tribunal classifies each issue as not indecent.

In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs in respect of the publications:

Memoirs of a Married Man, published by Kensington Publishing Corporation, Ind. 25/79;
The French Kiss, author: J. J. Montague, published by The Canyon Books, Ind. 26/79;
The Girl in the Plywood Box, author: William R. Bentley, published by Brandon Books, Ind. 27/79;
The Amazing Mary Millington, published by Futora Publications Ltd., Ind. 18/79.

Decision

These four books were commercially imported, seized by Customs, and came before the Tribunal as the importer disputes seizure. The last purports to be biographical in the first person. The other three are presented as fiction. All four are little more than collections of descriptions of sexual encounters in explicit detail. There is no literary or other merit in any of the books. Nothing therefore outweighs the dominant and prurient nature of each of the books. They are without any redeeming feature.

The Tribunal classifies each book as indecent.

Notice is hereby given that, pursuant to section 11 of the Animals Act 1967, the land and premises of Wrightson N.M.A. Ltd., sale grounds, situated at the northern end of Racecourse Road, Trentham, comprising approximately 1 hectare and known as "J and K Block" is hereby set apart and defined to be a quarantine ground for the detention of imported horses from 10 February 1980 to 20 September 1980.

Bona Vacantia Disclaimed

In the matter of section 338 of the Companies Act 1955, and in the matter of GUTHRIE & LARNACHS NEW ZEALAND TIMBER AND WOODWARE FACTORIES LIMITED (a dissolved company):

Notice is hereby given as follows:

  1. That on the 7th day of November 1979 it came to the notice of the Secretary to the Treasury that the estate in fee simple of the above-named Guthrie & Larnachs New Zealand Timber and Woodware Factories Limited, in all that piece of land situated in the City of Invercargill containing (subject to survey) 1247 square metres, more or less, being part section 42, Block XIX, Invercargill Hundred (being more particularly described as that part of Block II, Deposited Plan 110, shown on that said Deposited Plan as Lord Street, bounded to the north by Hyde Street, to the east by Lot 1, Deposited Plan 8317, and part Lot 9, Block II, Deposited Plan 110; to the south by that part of the said Section 42 as is comprised in certificate of title, folio 3A/1052; and to the west by Lots 2, 4, and 6, Block II, Deposited Plan 110); and being the balance of the land comprised and described in certificate of title, Volume 19, folio 104, Southland Registry, had vested in the Crown pursuant to section 337 of the above-mentioned Act;

  2. That on the date aforesaid application was received by the Secretary to the Treasury for the Crown's title to the said estate in fee simple to be disclaimed;

  3. That no such application as aforesaid was received by the Secretary to the Treasury before the date aforesaid;

  4. That the Crown's title to the said estate in fee simple is hereby disclaimed.

Trading Bank Reserve Asset Ratios

Pursuant to section 33 of the Reserve Bank of New Zealand Act 1964, the Reserve Bank, acting with the approval of the Minister of Finance, hereby gives notice that as from the close of business on 1 February 1980, and until further notice each trading bank shall maintain during each calendar month balances at the Reserve Bank plus holdings of Reserve Bank notes and of New Zealand Government securities, such that the aggregate of the averages of those balances and holdings during that calendar month (determined in accordance with clauses 1, 2, 3, and 4 of this notice) equals or exceeds the aggregate of:
