Appointment of Committee Under the Ministry of Agriculture and Fisheries Act 1953 (Notice No. 2487, Ag. 4/54/19)
PURSUANT to section 12 of the Ministry of Agriculture and Fisheries Act 1953, I hereby appoint David Hendy Kay of Wellington, accountant, at the request of the New Zealand Honey Marketing Authority to act as a committee to:
(a) investigate into the matters set out in this notice affecting the honey industry, and
(b) to report to me on his investigation not later than the 31st day of March 1981,
with the cost of the investigation to be borne by the Authority after consultation with me.
A. MATTERS FOR INVESTIGATION
In the event of dissolution or reorganisation of the New Zealand Honey Marketing Authority to whom or for whose benefit should the net assets of the New Zealand Honey Marketing Authority belong:
(a) If the whole or some part of those assets may be attributed to past and present suppliers of the New Zealand Honey Marketing Authority how should those funds be used or made available for the use or benefit of such suppliers, and
(b) If the whole or some part of those assets may be attributed to the whole of the honey industry (including packers and producers as defined in the legislation) how should those funds be used or made available for the use or benefit of the industry as a whole.
The Committee may at any time conduct any investigation into the records and accounts of the Authority for any purpose it may deem to be necessary, including to ascertain the assets of the Authority and how they were obtained or established. The Committee may obtain such independent valuations of any asset as it may think fit. It may make any ruling or decision as to procedure of the enquiry as it decides shall be necessary for its efficient and expeditious conduct, including the making of any interim decision on all or any of the matters under investigation, and the calling of any evidence it may require.
