Decision
This collection of books was referred to the Tribunal for classification from the District Court at Christchurch. Mr Bates for the Police made the very simple submission that these books were so plainly indecent that no further elaboration was required. The books and magazines have been grouped in numbered sections.

These publications contain no text and comprise a series of photographs showing both males and females having sexual relations with a donkey.

These are apparently published at regular intervals and deal essentially with sado-masochism. The text is a mixture of English, Swedish, and German and the photographs are all of a homosexual nature.

These are apparently published at regular intervals and are sub-titled "Pornography In Colour". They largely comprise photographs but in two cases (numbers 83 and 85) there is a text in two languages. The text is minimal. Some are lesbian and some are heterosexual.

These publications are a collection of photographs but all except Lesbian Quarter contain some text. The titles sufficiently explain the nature of the publications.

These are homosexual publications, largely photographs, but in some cases having an appropriate text. In one case (Slide Into Love), the text is printed in three languages—English, Swedish, and German.
6, 7, 8, and 9. These are publications dealing with heterosexual activities. In two cases (Black C . . . and Cherries), there is an accompanying text, included no doubt, to impart an aura of respectability.
10 and 11. These publications contain a collection of very young girls dressed and undressed in posed and natural positions. There is no text.
- This booklet, without text, contains a series of photographs of a homosexual relationship.
The brief descriptions of these publications do not give any real indication of their nature. The dominant effect of each is to arouse feelings of utter revulsion. The titles of some are in themselves disgusting and the illustrations in most cases are likewise disgusting. As some have no text there can be no claim to literary merit. It would be no injustice to say that none of the others have any literary or artistic merit. No one is likely to benefit from any publication and it seems to the Tribunal that there is a lack of honesty of purpose. Indeed it would seem that they have a clear dishonesty of purpose to corrupt any reader. They are patently offensive with a plain concentration upon the prurient. They have no redeeming features and could be called the "Rolls Royce of Pornography".
In the public interest and for the public good these publications are classified as indecent.

Decision
These publications were imported commercially and were seized at Auckland in June 1979. Forfeiture was disputed by the importer.
So far as T and T is concerned, Volume 1, No. 2, was considered by the High Court in its decision released on 25 July and the magazine was then declared indecent. This issue is no different from Volume 1, No. 2, and it is accordingly classified as indecent.
The other volume is concerned mainly with oversized breasts but there is a significant number of photographs of the genital area, some in contrived positions. There is no artistic merit in the book. It concentrates on prurient and lewd aspects of sex and quite distinctly has a dishonesty of purpose. It is likewise classified as indecent.

Decision
These volumes were all seized by the Customs Department in Auckland and come before the Tribunal as disputed forfeitures.
With the exception of Bushland Seduction which has minimal text, these comprise pictures of nude or near-nude females. It was submitted by the Comptroller that the publications are devoted solely to the exploitation of the female form and that many of the pictures are artificial or contrived. The importer, Waverley Publishing Co. Ltd., made written submissions in respect of these publications. It was submitted on behalf of the importer that these publications were similar to those recently classified R18 by the High Court. The Tribunal must, of course, have due regard for decisions of the High Court and it appears to the Tribunal that where pictorial matter consists of simple nudity without undue emphasis on genital areas, an age restriction of some sort should be the classification attached to them.
In these particular cases, although there is a good deal of photography relating to the genital area few, if any, are really contrived and in most cases, consist merely of frontal nudes.
Each of these books is classified as indecent in the hands of persons under the age of 18.
