THE RIVERTON BOROUGH COUNCIL

NOTICE OF INTENTION TO TAKE LAND

IN the matter of the Local Government Amendment Act 1978 and the Public Works Act 1928, notice is hereby given that the Riverton Borough Council proposes under the provisions of the above-named Acts to execute a certain public work, namely, to acquire land for road in the Borough of Riverton, and for the purposes of such public work the land described in the Schedule hereto is required to be taken. A plan of the land so required is deposited in the Council Office, at Palmerston Street, Riverton, where it is open for inspection during ordinary office hours. All persons directly affected by the taking of such land who have any objection to the taking of the said land must state their objections in writing, not being an objection to the amount or payment of compensation, and send the written objection within 40 days after the first publication of this notice to the Registrar, Planning Tribunal, Tribunals Division, Private Bag, Postal Centre, Wellington. If any such objection is made, a public hearing of the objection will be held unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

NOTICE OF INTENTION TO TAKE EASEMENT OVER LAND

IN the matter of the Public Works Act 1928, and in the matter of the Wellington Regional Water Board Act 1972; Notice is hereby given that the Wellington Regional Water Board, a Board duly constituted under the provisions of the Wellington Regional Water Board Act 1972 and being the local authority within the meaning of the Public Works Act 1928, proposes under the provisions of the above-mentioned Acts and under the provisions of all other Acts and by all other powers and authorities enabling it in that behalf to execute a public work namely waterworks, and for the purposes of such public work to take an easement over the lands set out in the First Schedule hereto in the terms set out in the Second Schedule hereto.

And notice is hereby further given that a plan of those portions of the land referred to in the First Schedule hereto in respect of which the easement is required to be taken has been lodged in the office of the Chief Surveyor, Department of Lands and Survey, at Wellington, and their numbered Survey Office Plan No. 31525, and a copy thereof is exhibited at the offices of the Board at the M.E.D. Building, 40-44 Cuba Street, Wellington, and is there available for inspection by all persons, without fee, during ordinary office hours. All persons who are affected by the execution of the said public work or by the taking of the easement over the said lands, and who have any objection to the execution of the said public work or to the taking or the easement over the said lands or any of them should state their objections in writing, and send the same within forty (40) days after the first publication of this notice to the Registrar of the Planning Tribunal, care of Tribunals Division, Private Bag, Postal Centre, Wellington.

And notice is hereby further given that if any objection is received as aforesaid and unless the objector otherwise requires a public hearing of any such objection will be held and each objector will be advised of the time and place of the hearing.

FIRST SCHEDULE

ALL those pieces of land situated in the Kapiti Borough having frontage to the Waikanae - Upper Hutt road and lying between that road and the Waikanae River and described as follows:

(a) All that parcel of land containing 1470 square metres, more or less, situate in Blocks IX and X, Kaitawa Survey District, being part Lot 3 on Deposited Plan No. 32514, and being part of the land comprised and described in certificate of title, Volume 15C, folio 823 (Wellington Registry), subject as to the part shown coloured yellow on plan 32514 to the right of way created by order of Court 731 the registered proprietor whereof is John Remington Nash, of Paramata, company director.

(b) All that parcel of land containing 2474 square metres, more or less, situate in Blocks IX and X, Kaitawa Survey District, being part Lot 2 on Deposited Plan No. 32514, and being part of the land comprised and described in certificate of title, Volume 15C, folio 822 (Wellington Registry), subject as to the part shown coloured yellow on plan 32514 to the right of way created by order of Court 731 the registered proprietor whereof is John Remington Nash, of Paramata, company director.

(c) All that parcel of land containing 1427 square metres, more or less, situate in Blocks IX and X, Kaitawa Survey District, being part Ngaraa West B23, and being also part Lot 2 on Deposited Plan No. 28171, and being part of the land comprised and described in certificate of title, Volume F4, folio 355 (Wellington Registry), the registered proprietors whereof are John Benseman, draughtsman, and Peter Kelvin Heginbotham, optometrist, both of Wellington, as tenants in common in equal shares.

(d) All that parcel of land containing 286 square metres, more or less, situate in Blocks IX and X, Kaitawa Survey District, being part Ngaraa West B23, and being also part Lot 1 on Deposited Plan No. 28171, and being part of the land comprised and described in certificate of title, Volume F4, folio 354 (Wellington Registry), the registered proprietor whereof is James Keith Napier of Raumati South, company director.

(e) All that parcel of land containing 1635 square metres, more or less, situate in Blocks IX and X, Kaitawa Survey District, being part Ngaraa West B23, and being also part Lot 7 on Deposited Plan No. 28171, and being part of the land comprised and described in certificate of title, Volume F4, folio 360 (Wellington Registry), the registered proprietor whereof is Victor Frederick Dovereux of Wellington, electrician.

(f) All that parcel of land containing 315 square metres, more or less, situate in Block IX, Kaitawa Survey District, being part of Section 41, Ngaraa West C Block, and being also part Lot 1 on Deposited Plan No. 24273, and being part of the land comprised and described in certificate of title, Volume B1, folio 1348 (Wellington Registry), the registered proprietor whereof is M. S. D. Spiers Limited, a duly incorporated company having its registered office at Marton.

(g) All that parcel of land containing 1758 square metres, more or less, situate in Blocks IX and X, Kaitawa Survey District, being part Ngaraa West C11 and C23 and accretion, and being also part Lot 3 on Deposited Plan No. 28171 and part of the land comprised and described in certificate of title, Volume F4, folio 356 (Wellington Registry), the registered proprietor whereof is Peter Kelvin Heginbotham of Wellington, optician.
