GOODS

  1. Demurrage

This section is hereby revoked and the following new section substituted:

  2. Demurrage, at the rates prescribed in paragraph 3 hereof will be charged as follows:
    (a) On each wagon loaded with goods which it is the duty of the consignee to unload, and
    which is not completely discharged within 8 working hours from the time that the
    wagon is available for unloading.
    (b) On each wagon ordered, and not loaded, or improperly loaded, or loaded and not
    ready for dispatch within 8 working hours from the time such wagon is made available
    for loading in pursuance of such order.

  3. Working Hours—For the purposes of calculating demurrage charges in terms of this
    section, "Working Hours" shall be deemed to be from 8 a.m. to 5 p.m. Monday to Friday
    inclusive. The following days will not be counted when calculating demurrage charges:
    Saturdays.
    Sundays.
    Other days on which goods sheds are closed, including Anniversary Day, or the day observed
    in lieu thereof, in each province.

  4. Charges for demurrage will be as follows:
    Four-wheeled wagons—$26.48 per wagon for each succeeding 8 working hours or part
    thereof.
    Bogie Wagons—$52.96 per wagon for each succeeding 8 working hours or part thereof.

  5. Duty to Unload—For the purpose of subparagraph 1 (a) it shall be deemed to be the
    duty of the consignee to unload goods in the following instances:
    (a) Wherever it is specifically provided "Owners to unload" or words to that effect; and
    (b) Where goods, irrespective of classification are put off at a station or siding where there
    is no Stationmaster in charge; or placed in a private siding; and
    (c) When goods, irrespective of classification are consigned in wagon lots from one con-
    signor to one consignee; and
    (d) In all cases other than where storage charges apply in terms of section 102.

  6. Privately Owned Containers—Wagons containing privately owned containers (including
    import/export containers and sea freighters) will be charged demurrage in terms of this section
    irrespective of whether such containers are empty or loaded.

  7. Department May Unload—The department reserves to itself the right to unload wagons
    on hand in excess of 8 working hours from the time that the goods are available for delivery
    at the sole risk and expense of the owner or consignee.

  8. Liability—Goods which it is the duty of the consignee to unload, on hand awaiting
    delivery, will be held at owner's risk after 8 working hours from the time when the wagon
    is available for unloading.
