Commission of Inquiry into Wage Relativities on New Zealand Vessels

ORDER IN COUNCIL
To all to whom these presents shall come, and to:
GEORGE OLIVER WHATNALL, of Ohope, former President of the Industrial Commission;
NORRIS ARTHUR COLLINS, of Paekakariki, retired General Secretary of the National Union of Railwaymen; and
GEOFFREY ANTHONY POYNTER LIGHTBAND, of Lower Hutt, retired Operations Manager for BP New Zealand Limited:
GREETING:
WHEREAS it is expedient that inquiry should be made into the wage relativities on New Zealand vessels;
Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, The Right Honourable Sir Keith Jacka Holyoake, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said George Oliver Whatnall, Norris Arthur Collins, and Geoffrey Anthony Poynder Lightband, to be a Commission to inquire into, report upon, and make recommendations upon—
(a) The remuneration (including the salaries, increments, allowances, and leave) and the travelling arrangements applicable in respect of all seafaring positions filled by members of the New Zealand Merchant Service Guild Industrial Union of Workers, the New Zealand Seamen’s Union Industrial Union of Workers, the New Zealand Institute of Marine and Power Engineers Incorporated, or the Federated Cooks and Stewards of New Zealand Industrial Union of Workers on vessels specified—
(i) In the New Zealand Maritime Industry (Scag-Going) Award dated the 14th day of April 1978; or
(ii) In any instrument that supersedes or partially supersedes that Award;
(b) The wage relativities and terms and conditions of employment, which, as determined by you, should be applicable in respect of the seafaring positions specified in paragraph (a) hereof;
(c) The manner in which any changes recommended by you should be implemented, including the manner in which, and the dates on which any recommended changes should be phased in;
(d) Any other matters that may be thought by you to be relevant to the general objects of the inquiry;
And in considering the aforesaid matters you are hereby directed to have regard to—
(e) The responsibilities, qualifications, skills, work experience, workload, and duties of the different classes of workers involved, including their respective working environments and their respective hours of work (including the span of those hours); and
(f) Such other considerations as you may determine as relevant to the general objects of the inquiry:
And, with the like advice and consent, I hereby appoint you the said George Oliver Whatnall to be the Chairman of the said Commission:
And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you consider expedient, with power to adjourn from time to time and from place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:
And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, except to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in exercise of the powers conferred upon you except such evidence or information as is received in the course of a sitting open to the public.
