the South Auckland Education Board as a Site for a School,
to be Vested in Her Majesty the Queen

A PROCLAMATION
PURSUANT to subsection (6) of section 5 of the Education
Lands Act 1949, I, The Right Honourable Sir Keith Jacka
Holyoake, the Governor-General of New Zealand, hereby
proclaim and declare that the land described in the Schedule
hereto, being an area vested in the South Auckland Education
Board as a site for a school, shall be vested in Her Majesty
the Queen, freed and discharged from every education trust
affecting the same, but subject to all leases, encumbrances,
liens, or easements affecting the same at the date hereof.
SCHEDULE
SOUTH AUCKLAND LAND DISTRICT—OTOROHANGA COUNTY
1.2141 hectares, more or less, being Section 2, Block X, Town
of Kawhia, situated in Block IX, Kawhia North Survey
District. All New Zealand Gazette, 1898, p. 188. S.O. Plan
3237.
Given under the hand of His Excellency the Governor-
General, and issued under the Seal of New Zealand, this
13th day of March 1979.

ORDER IN COUNCIL
At the Government Buildings this 19th day of
March 1979.
Present:
THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL
PURSUANT to section 165 of the Harbours Act 1950, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby makes
the following order.
ORDER
-
(a) This order may be cited as the Mount Maunganui
Borough Council Foreshore Control Order 1979.
(b) This order shall come into force on the date of its
publication in the Gazette. -
In this order—
“The Act” means the Harbours Act 1950;
“The Council” means the Mount Maunganui Borough
Council;
“Foreshore” means such parts of the bed, shore, or banks
of a tidal water as are covered and uncovered by the
flow and ebb of the tide at ordinary spring tide;
“Minister” means the Minister of Transport, and includes
any officer, person, or authority acting by or under the
direction or authority of the Minister. -
There is hereby granted to the council for a period of
21 years from the commencement of this order, the control
of the foreshore described in the First Schedule to this order,
subject to the provisions of section 165 of the Act, and to
the conditions specified in the Second Schedule to this order. -
The Order in Council of 3 November 1965* granting to
the Mount Maunganui Domain Board control of the portion
of the foreshore at Mount Maunganui commencing at the
north-western side of Beach Road and extending generally
south-eastwards to the easterly boundary of the signal station
reserve is hereby revoked.
FIRST SCHEDULE
All that area of foreshore being adjacent to the north-
eastern boundary of the Borough of Mount Maunganui
commencing at a point at the eastern boundary of the
Borough at high-water mark and thence north-westerly
following the high-water mark to a point where high-water
mark intersects a line bearing 070 degrees true from trig.
point Maunganui A on Mount Maunganui, as more particu-
larly shown on plan numbered M.D. 15936, and deposited in
the office of the Ministry of Transport at Wellington.
SECOND SCHEDULE
CONDITIONS
- Her Majesty, the Governor-General and all officers in
the Government Service acting in the execution of their duty
shall, at all times have free ingress, passage, and egress into,
over, and out of the foreshore described in the First Schedule
to this order, without payment.
