Declaring Land and Easements Over Land Taken for Waterworks in the City of Waitemata

PURSUANT to section 32 of the Public Works Act 1928, and section 35 of the Finance Act (No. 2) 1945, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for waterworks and shall vest in the Waitemata City Council and that a right of way easement appurtenant to the land described in the said First Schedule is hereby taken over the land described in the Second Schedule hereto for waterworks, vesting in the Waitemata City Council the rights contained in the provisions of paragraph 1 of the Seventh Schedule to the Land Transfer Act 1952, and that a water pipeline easement appurtenant to the land described in the said First Schedule is hereby taken over the land described in the Third Schedule hereto for waterworks, vesting in the Waitemata City Council the rights contained in the provisions of paragraphs 2 and 5 of the Seventh Schedule to the Land Transfer Act 1952, from and after the 22nd day of February 1979.
