ORDER IN COUNCIL

At the Government Buildings at Wellington this 7th day of November 1978

Present:

THE HON. T. F. GILL PRESIDING IN COUNCIL

PURSUANT to section 101C (2) of the Industrial Relations Act 1973, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the recommendation of the Minister of Labour, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the New Zealand Licensed Hotel Clerical Workers Unqualified Preference Provision Order 1978.
    (2) This order shall come into force on the day after the date of its publication in the Gazette.

  2. Interpretation—In this order the term “the existing award” means the award dated the 10th day of August 1978 and known as the New Zealand Licensed Hotel Clerical Workers—Award.

  3. Unqualified preference provision negated—It is hereby declared that the unqualified preference provision contained in the existing award shall be of no effect as from the coming into force of this order.

  4. Conditions on which new unqualified preference provision may be inserted—It is hereby declared that an unqualified preference provision shall be inserted in the existing award (or in any award or collective agreement made in substitution for the existing award) only—
    (a) Pursuant to section 99 (b) of the Industrial Relations Act 1973; or
    (b) If not less than 50 percent of the valid votes recorded in a ballot conducted pursuant to section 101A of the Industrial Relations Act 1973, subsequent to the coming into force of this Order in Council, are in favour of the insertion in the award or collective agreement of an unqualified preference provision.
