Declaring Land and an Easement Over Land Taken for Waterworks in Block XIV, Tauranga Survey District, Tauranga County
PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for waterworks, and that the easement in gross described in the Second Schedule hereto is hereby taken for waterworks over the land described in the Third Schedule hereto, and both the said land and easement shall vest in the Tauranga City Council (hereinafter called “the Council”), from and after the 19th day of October 1978.
FIRST SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Land Taken for Waterworks
ALL that piece of land containing 2247 square metres, situated in Block XIV, Tauranga Survey District, being part Kaitimako C Block; as shown on plan S.O. 49225, lodged in the office of the Chief Surveyor at Hamilton, and thereon marked “A”.
SECOND SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Description of Easement
The full, free, and uninterrupted right, licence, privilege, and authority at all times hereafter in perpetuity for the Council, its successors and assigns to carry, convey, lead, drain, or discharge from the reservoir to be constructed on the land described in the First Schedule hereto, into, through, and along pipes to be constructed through, under, and along the land described in the Third Schedule hereto, and for such purposes from time to time to dig up to any depth and again fill in the soil of the said drainage easement, and to alter, repair, and maintain the pipes and/or concrete and/or other conduits, and to lay down, construct, erect, and make in, through, or under such portion of the said land/pipes and/or concrete and/or other conduits of such size as the Council shall think fit for carrying and conveying the said water with such manholes, valves, and surface boxes as the Council shall think fit, and from time to time inspect, maintain, cleanse, repair, extend, remove, and enlarge such pipes and/or concrete and/or other conduits, manholes, valves, and surface boxes, and to have to the same for any such purpose access to and from the street across the land described in the First Schedule hereto, and from time to time repair and maintain all works in connection therewith, and also full power and authority for the Council, its surveyors, engineers, workmen, agents, and servants, with or without horses, carts, and other vehicles and machinery from time to time, and at all times to enter and remain for any of the purposes aforesaid upon such portion of the land described in the Third Schedule hereto as shall be necessary for such purposes, and generally to do and perform such acts and things in or upon the said land as may be necessary or proper for or in relation to any of the purposes aforesaid.
THIRD SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Land Over Which Easement is Taken
ALL that piece of land, situated in Block XIV, Tauranga Survey District, being part C. Kaitimako Block; as shown on plan S.O. 49808, lodged in the office of the Chief Surveyor at Hamilton, and thereon marked “B”.
