“They are frankly pornographic. However that does not
render them indecent.”
They are simply a collection of sexual incidents put together
in the form of a novel but with no attempt at either character
or plot development. Having read them the Tribunal has no
hesitation in finding each of them indecent.
Of the remaining items, three have already been considered
by the Tribunal and found indecent. They are Mankind, No.
4, Decision 855 (New Zealand Gazette, 13 May 1976), Aus-
tralian Golden Boys, Vol. I, No. 1, Decision 772 (New Zealand
Gazette, 23 August 1975), and Q Q Magazine, March/April
1971, Vol. 3, No. 2, Decision 790 (New Zealand Gazette 4
April 1974). As he is entitled to do under section 18 (2) of
the Indecent Publications Act 1963, Mr Maling challenges
the previous decisions to which he was not a party and we
must therefore reconsider them.
These remaining items consist entirely or almost entirely
of photographs of naked young men photographed so as to
emphasize the penis or consist of articles, photographs, and
advertisements for homosexuals.
We have given careful consideration to the submissions
made to us and have had regard to all the matters and con-
siderations in section 11 of the Act. We have noted that two
of the earlier decisions were made some years ago but do
not feel that there has been any change in community standards
in this area which leads us to any different view. We have also
noted that these are importations of single copies and there
appears to be no intention of distribution.
In the end we conclude, as we did on similar publications
and one identical in Decision 855, that the dominant effect
of each is objectionable and injurious to the public good and
without any redeeming merit on literary, artistic, scientific,
or other grounds.
The Tribunal makes no decision on the 10 photographs. The
Tribunal classifies each other book and magazine as indecent.

Standard Specification Available for Comment

PURSUANT to subsection (3) of section 23 of the Standards
Act 1965, notice is hereby given that the following draft
amendment is being circulated.

Qualification tests for manual metal-arc welders.
This amendment clarifies the qualifications and experience
required for certifying officers and supervisors.
All persons who may be affected by this amendment and
who desire to comment thereon may obtain copies from the
Standards Association of New Zealand, World Trade Center,
15-23 Sturdee Street (or Private Bag), Wellington.
The closing date for the receipt of comment is 31 March
1978.
