The Electoral Main Rolls Closing Order 1978

ORDER IN COUNCIL

At the Government House at Wellington this 26th day of June 1978

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL PRESIDING IN COUNCIL

PURSUANT to section 61 of the Electoral Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order may be cited at the Electoral Main Rolls Closing Order 1978.

  2. The date for the closing of the main roll in every General and Maori electoral district for the year 1978 shall be Wednesday, the 26th day of July 1978.

The Electoral Act (Validation of Irregularities) Order 1978

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS, by section 49 (1) (b) of the Electoral Act 1956, each applicant for registration as an elector was required to be notified, within 3 months after the proclaiming of the boundaries of the electoral districts constituted by the Proclamation published in the Gazette on the 20th day of June 1977* (hereinafter referred to as the said Proclamation), of the electoral district in which he was enrolled: And whereas the notifications were not given within the said period of 3 months: And whereas the electoral rolls for the General electoral districts constituted by the said Proclamation and for the Maori electoral districts were not compiled within the said period of 3 months as required by section 60 (1) of the Electoral Act 1956: And whereas Electorate Officers for the electoral districts constituted by the said Proclamation were not appointed under section 7A of the Electoral Act 1956 before the expiration of the said period of 3 months: And whereas the tenor of the Electoral Act 1956 is such that Electorate Officers should have been appointed for those electoral districts in sufficient time for those Officers to have compiled, within the said period of 3 months, the rolls for the said electoral districts:

Now therefore, pursuant to section 187 of the Electoral Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the Electoral Act (Validation of Irregularities) Order 1978.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. Appointment of Electorate Officers—Each appointment of an Electorate Officer for an electoral district constituted by the said Proclamation, being an appointment made under section 7A of the Electoral Act 1956 before the commencement of this order, is hereby declared to be and always to have been validly made, notwithstanding that the appointment was made after the time when it should have been made in accordance with the tenor of the Electoral Act 1956.

  2. Compilation of electoral rolls—(1) The period specified in the Preamble to this order, being the period within which the Electorate Officer for each General electoral district or Maori electoral district was required, pursuant to section 60 (1) of the Electoral Act 1956, to compile an electoral roll for the district, is hereby extended until the close of the 26th day of July 1978.

(2) Each electoral roll compiled, whether before or after the commencement of this order but not later than the close of the 26th day of July 1978, for any electoral district constituted by the said Proclamation is hereby declared to be and always to have been validly compiled, notwithstanding that it was not compiled within 3 months after the gazetting of the said Proclamation.

  1. Notification of applicants—(1) The period specified in the Preamble to this order, being the period within which each applicant for registration as an elector was required to be notified of the electoral district in which he was enrolled, is hereby extended until the close of the 12th day of August 1978.

(2) Each notification given (whether before or after the commencement of this order but not later than the close of the 12th day of August 1978) for the purposes of section 49 (1) (b) of the Electoral Act 1956 is hereby declared to be and always to have been validly given, notwithstanding that the notification was not given within 3 months after the proclaiming of the boundaries of the electoral district by the said Proclamation.

Appointing a Non Elective Member of the South Canterbury Catchment Board

PURSUANT to section 44 of the Soil Conservation and Rivers Control Act 1941, I, The Right Honourable Sir Keith Jacka Holyoake, the Governor-General of New Zealand, hereby appoint

John Edward Friel, of Christchurch, an officer of the Department of Lands and Survey

to be a member of the South Canterbury Catchment Board.

As Witness the hand of His Excellency the Governor-General this 12th day of June 1978.
