Declaration That Land is a Reserve
PURSUANT to the Reserves Act 1977, and to a delegation from the Minister of Lands, the Assistant Director of Reserves of the Department of Lands and Survey hereby notifies that the following resolution was passed by the Takapuna City Council on the 16th day of August 1977:
“That, in exercise of the powers conferred on it by section 14 of the Reserves Act 1977, the Takapuna City Council hereby resolves that the piece of land held by it in fee simple and, described in the Schedule hereto, shall be, and the same is hereby, declared to be a reserve for historic purposes within the meaning of the said Act.”

NORTH AUCKLAND LAND DISTRICT—TAKAPUNA CITY
LOTS 7 and 8, D.P. 8563, being part Allotment 190, Takapuna Parish, situated in Block III, Rangitoto Survey District: area, 1.1305 hectares, more or less. All certificate of title, No. 35C/819, of the North Auckland Land Registry.

Naming of a Reserve
PURSUANT to the Reserves Act 1977, and to a delegation from the Minister of Lands, the Assistant Director of Reserves of the Department of Lands and Survey hereby declares that the reserve for scenic purposes, described in the Schedule hereto, shall hereafter be known as the Broadwood Scenic Reserve.

Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963, and in the matter of a reference by the Magistrate’s Court at Wellington for a decision in respect to the following publication: The Joy of Sex (hard cover) published by Quartet Books Ltd. of London.

DECISION OF THE TRIBUNAL
This is the hard-bound edition of a book which in its paperback edition was considered by the tribunal on 18 August 1975 (Decision No. 848, New Zealand Gazette 6/11/1975, No. 98, p. 2455). That edition was classified as indecent in the hands of persons under 16.
The hard-bound edition has been available in New Zealand for some years and was apparently available before the paperback edition. It has been on sale since. It comes before us on a reference from the Magistrate’s Court in Wellington in connection with a prosecution of a Wellington bookseller.
It is necessary that the tribunal considers separately the hard-bound and paperback edition of a book because there may be differences in form and content, as there are in this case, and because the considerations to which we must refer under section 11 of the Act may apply in different ways and to different extent to each such edition.
In submissions made to us, emphasis was put on the effect of the offences in sections 21 and 22, in particular in exhibiting a book, in cases where age classification applied. It was our understanding of those submissions that we should have regard to these difficulties in exercising our functions under the Act.
The functions of the tribunal are clearly and exhaustively set out in section 10. These enjoin us to classify a book in one of the five ways there set out. As has been said before the tribunal has no function to police its decisions. Indeed it is not entitled to take into consideration any alleged lack of policing or any alleged prohibitory effect of any classification. Those are matters for the Legislature or the Government not for us.
The edition now before us in substance the same as the paperback edition. We have carefully considered the book anew and have regard to each of the matters set out in section 11. While this book is sold at a higher price than the paperback edition, that is not enough in itself in these times of comparative affluence of the young, to change our view that what the tribunal decided in 1975, in respect of the paperback edition, is equally applicable now to this edition. There are no doubt changes in the standards which apply to a book such as this but we do not believe that in the last 3 years any such changes affect our consideration of this book.
The tribunal classifies the hard-bound edition of The Joy of Sex as indecent in the hands of persons under 16.
