NOTICE OF INTENTION TO TAKE LAND

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act 1928, and the Counties Act 1956, to take for roading purposes, the land described in the Schedule hereto, and notice is hereby further given that the plan of the land so required to be taken is deposited in the office of the Waimairi County Council, situated on the corner of Jeffreys Road and Clyde Road, Fendalton, and is open for inspection without fee by all persons during ordinary office hours. All persons directly affected by the taking of the said land, should, if they have any objection to the amount or payment of compensation, make a written objection and send it within forty (40) days after the first publication of this notice, to the Secretary, Town and Country Planning Appeal Board, Post Office Box 12244, Wellington North. If any objection is made in accordance with this notice, a public hearing of the objection will be held unless the objector otherwise requires and each objector will be advised of the time and place of the hearing.

AUCKLAND REGIONAL AUTHORITY

NOTICE OF INTENTION TO TAKE LAND

THE Auckland Regional Authority, a body corporate constituted under the Auckland Regional Authority Act 1963 (hereinafter called “the Authority”) hereby gives notice that whereas:

(a) the land described in the Schedule hereto was designated, pursuant to and for the purposes of section 34L of the Auckland Regional Authority Act 1963, as highway improvement land in the operative district scheme of the Borough of One Tree Hill (prepared under the Town and Country Planning Act 1953);

(b) the said section 34L was repealed as from the 1st day of April 1977 by section 14 of the Local Government Amendment Act 1976, and section 93 of the Local Government Act 1974 was applied to the Authority;

(c) by virtue of the said section 14 of the Local Government Amendment Act 1976, the repeal of the said section 34L shall not affect the validity, effect, or consequences of anything done thereunder before the 1st day of April 1977, and everything so done continues in force and has effect from and after the said 1st day of April 1977 as if it had been done under the said section 93 of the Local Government Act 1974;

now therefore:

The said land is required to be taken and that the Authority intends, under the powers vested in it by the Local Government Act 1974, and the Public Works Act 1928, to take the said land described in the said Schedule hereto under the Public Works Act as and for road improvement land. And notice is hereby further given that a plan of the land so required to be taken is deposited in the office of the Authority’s secretary on the third floor of Regional House, corner of Hobson and Wellesley Streets, Auckland, and is open for inspection, without fee, by all persons during ordinary office hours. All persons directly affected by the execution of the said public work or by the taking of the said land, not being objections to the amount of compensation, must set forth such objection in writing and send the same within 40 days of the first publication of this notice to the Town and Country Planning Appeal Board at Wellington. If any objection is made in accordance with this notice, a public hearing of the objection will be held, unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

Forty-seven square metres (47 m²), more or less, being the land marked “B” on Survey Office Plan 52308, being part Lot 36, Deposited Plan 14346, being part Allotment 10, Section 12, Suburbs of Auckland, and being part of the land comprised and described in certificate of title, Volume 3D, folio 54 (North Auckland Registry), subject to lease 33366, and situated at No. 78 Wheturangi Road, Greenlane.
