Exempting Land in Southland Land District from the Operation of Part III of the Coal Mines Act 1925

PURSUANT to section 171 of the Coal Mines Act 1925, I, The Right Honourable Sir Keith Jacka Holyoake, the Governor-General of New Zealand, do hereby exempt the lease described in the Schedule hereto from the operation of Part III of the said Act.
SCHEDULE
RENEWABLE lease of Urban Land No. 33, containing 1012 square metres, more or less, situated in the Land District of Southland, being Lot 8, Block III, Deposited Plan 2745, being Part Section 20, Wairio Survey District, C.T. Vol. 177, folio 249.
As witness the hand of His Excellency the Governor-General this 28th day of October 1978.

Waitangi National Trust Board Bylaws 1978
PURSUANT to the powers conferred on it by section 7 of the Waitangi National Trust Board Act 1932, the Waitangi National Trust Board doth hereby resolve that the Waitangi National Trust Board Bylaws 1964 and amendments thereto be revoked, and that the provisions set out in the Schedule to this resolution be bylaws of the board and be submitted for approval to His Excellency the Governor-General, and following such approval be thereupon published by being displayed and kept displayed as provided by subsection (4) of the said section 7.
SCHEDULE
BYLAWS
The bylaws set out in the consecutively numbered clauses hereof may be cited as the Waitangi National Trust Board Bylaws 1978.
Interpretation
- In these Bylaws:
“Board” means the Waitangi National Trust Board appointed under the said Act.
“Officer” or “Servant” means those persons from time to time appointed as officers or servants of the board.
“The said land” means all the land from time to time vested in the board.
Animals
- No person shall bring any dog or cat, or other animal or cause or permit any dog or cat or other animal to be brought upon any part of the said land, and any dog or cat or other animal intruding upon any part of such land without authority may be taken into possession and committed to the local pound or the SPCA.
Camping
- No person shall camp on the said land.
Misbehaviour
- (i) Within the said land no person shall wilfully obstruct, disturb, or interfere with any other person in the use or enjoyment of the said land or use foul, abusive, indecent or obscene language, or be intoxicated, noisy or riotous, or in any way misbehave.
(ii) Where any person commits an offence against the foregoing bylaw he shall be deemed to commit a further offence if he does not leave the said land when so requested by an officer of the board.
Planting
- No person shall plant any tree, shrub, or plant of any kind, or sow or scatter the seed of any tree, shrub, or plant of any kind, or introduce any substance injurious to plant life on the said land.
Tents, Booths, and Other Structures
- No person shall put up or erect any stall, booth, tent, swing, or structure of any kind within the said land except with the prior written permission of the board and then only at such place, for such time or term, of such dimensions, and subject to such conditions as are specified in the permit. Any fee charged by the board in respect of the permit shall be payable in advance.
Trading and Residence
- No person shall reside permanently, engage in any business, sell or offer for sale any article of food or merchandise, or any kind of drink, or carry on any other pursuit or calling within the said land without the written consent of the board given subject to such terms and conditions as it deems fit.
Public Address or Sound Systems
- No person shall install or operate any type of public address system or any type of amplified sound system on the said land without the prior written permission of the board and then only in accordance with the conditions of such permission.
Aircraft
- (i) No person shall make use of any part of the said land for the purpose of the landing or alighting thereon or the flying therefrom of aircraft of any kind (including aeroplanes, helicopters, gliders and balloons) except in accordance with written permission previously obtained from the board, but this bylaw shall not apply to the farm airstrip operated by the Department of Lands and Survey or in cases of emergency.
(ii) No person shall land on the said land by parachute except in cases of emergency.
(iii) No person within the said land shall use or operate or attempt to use or operate a hang-glider.
(iv) Further, no person, operator or pilot in command of an aircraft of any description shall make use of any part of the said land for the purpose of setting down, picking up or recovery from within the said land of any person, livestock, carcass or article of any description except in accordance with the written permission of the board previously obtained.
(v) This bylaw does not absolve persons from compliance with any requirements that the Director of Civil Aviation may stipulate.
Fires
- (i) No person shall light any fire, except at picnic places in fireplaces provided by the board, without the express permission of the board or officer of the board.
(ii) No person shall light a fire in any position where it is likely to present a fire hazard.
(iii) Once a fire is lit, the person lighting the fire, or such other person as is detailed by him, shall remain in attendance of the fire until it is completely extinguished.
(iv) No match, lighted or not lighted, cigarette, or other lighted matter shall be dropped, thrown or otherwise placed in any grass or other inflammable material.
(v) Nothing in this bylaw shall exempt an offender from liability under any other Act, with respect to the lighting of fires.
Litter
- No person shall deposit or throw on any part of the said land any litter, rubbish, or any substance or article of a dangerous or offensive nature or likely to be of a dangerous or offensive nature except in a place or receptacle provided or provided by an officer of the board for the purpose.
Dangerous Weapons
- No person shall at any time be or remain upon the said land having with him or use a firearm, airgun or similar weapon or instrument of a dangerous character (including, but without limiting the generality of the foregoing provisions, any bow and arrow, catapult, or shanghai).
Throwing Stones, etc.
- No person shall throw any stick, stone, or other missile within the said land.
Vehicle and Other Traffic
- (i) No person shall drive or ride any animal or any vehicle (whether propelled by mechanical power or not) within the said land in a manner which, having regard to all the circumstances of the case, is or might be dangerous to the public or to any person.
(ii) No person shall take, ride, or drive any animal or any vehicle (whether propelled by mechanical power or not) into or on the said land except upon such parts as are laid out for vehicular traffic.
- No person shall drive any vehicle at a speed exceeding 50 kilometres an hour on the said land or on any part of the said land laid out for vehicular traffic.
Parking
- (i) No person shall park any vehicle (not being a bicycle) within the said land except in a place set aside by the Board for the parking of vehicles.
