The Motor Launch (Porangahau River) Notice 1976, Waipukurau County Council

PURSUANT to the Motor Launch Regulations 1962, I, Owen John Conway, of the Ministry of Transport, in exercise of powers delegated by the Minister of Transport hereby give the following notice:

  1. (a) This notice may be cited as the Motor Launch (Porangahau River) Notice 1976.

(b) This notice shall come into force on the date of its publication in the Gazette, and shall remain in force until further notice.

  1. Regulations 11 (b), 11 (c) and 12 (b) and 12 (c) of the Motor Launch Regulations 1962 shall not apply between sunrise and sunset, except during the first weekend of any duck shooting season, and between 9 a.m. and 4 p.m. during subsequent weekends of any duck shooting season with respect to the area described in the First Schedule hereto.

FIRST SCHEDULE

ALL that area of the Porangahau River and estuary, downstream from a point marked by a notice board, as described in the Second Schedule hereto, erected on the west bank of the river, 400 metres upstream from the Beach Road Bridge, excepting thereout that area of water enclosed by straight lines commencing at a position where the centre line of the above bridge crosses the west bank of the river, thence to a position on the west bank of the river 30 metres in a southerly direction, thence to a position on the centre line of the bridge 15 metres from the west bank of the river, thence to a position on the west bank of the river 48 metres in a northerly direction from the point of commencement, thence to the position of commencement, also excepting thereout the remainder of the area of water under the bridge.

SECOND SCHEDULE

THE notice board, measuring not less than 600 millimetres by 750 millimetres, shall be painted bright orange with black lettering in the following form:

MOTOR LAUNCH REGULATIONS 1962

Downstream from this notice, excepting thereout that area shown cross hatched on the plan below, motor launches and water skiers may travel at speeds greater than 8 km/h between sunrise and sunset excepting:

  1. During the first weekend of any duck shooting season.

  2. Between 9 a.m. and 4 p.m. during any subsequent weekend of any duck shooting season.

  3. When passing within 30 metres of

(a) Any other vessel whether under way or moored;

(b) Any person bathing or fishing.

Licensing the Mount Wellington Borough Council to occupy a Site for a Boat Ramp at Flat Rock, Tamaki Estuary

PURSUANT to section 162 of the Harbours Act 1950, I, Owen John Conway, of the Ministry of Transport, in exercise of powers delegated by the Minister of Transport, hereby license and permit the Mount Wellington Borough Council (hereinafter called the licencee, which term shall include its successors or assigns unless the context requires a different construction) to use and occupy a part of the foreshore and bed of the Tamaki Estuary as shown on plan marked M.D. 10707 and deposited in the office of the Ministry of Transport at Wellington, for the purpose of maintaining thereon a boat ramp, as shown on the said plan, such licence to be held and enjoyed by the licencee upon and subject to the terms and conditions set forth in the Schedule hereto.

The licence* of 4 January 1974 authorising the Auckland Provincial Power Boat Club (Inc.) to occupy a site for a boat ramp at Flat Rock, Tamaki Estuary, is hereby revoked.

SCHEDULE

CONDITIONS

  1. This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.

  2. The term of the licence shall be 14 years from the 1st day of August 1977.

  3. The annual sum so payable by the licensee shall be ten cents (10c) payable on demand provided always that the Minister may review the annual sum payable at the end of the first year or any subsequent year of the said term.

Exemption of Certain Motor Vehicles from the Height Restriction for Stop Lamps and Rear Direction Indicator Lamps

PURSUANT to regulation 90 (1) of the Traffic Regulations 1976*, the Secretary for Transport hereby exempts motor vehicles of the type specified in the Schedule hereto from the requirements of regulations 61 (2) (a) and 63 (2) (a) which limit the height that a stop lamp and rear direction indicator lamp may be mounted above the ground, subject to the condition that this equipment shall not be fitted further above the 1.5 metre height restriction imposed by those regulations than is necessary to ensure its efficient use.
