(i) For beer sold in bottles containing 750 ml the authorised price a bottle containing 750 ml ruling at the particular premises on 31 July 1977, increased by 5 cents a bottle.
(j) For beer sold in bottles containing less than 750 ml the authorised price a bottle ruling at the particular premises on 31 July 1977, increased by 3 cents a bottle.
(k) For beer sold in cans the authorised price a can ruling at the particular premises on 31 July 1977, increased by—
(i) In the case of 340 ml cans, 3 cents a can.
(ii) In the case of 450 ml cans, 4 cents a can.
(l) For beer sold in a container other than those specified in paragraphs (a) to (e) of this clause the maximum price shall be that lawfully ruling on 31 July 1977, or such other price as the Secretary may from time to time authorise.

FIXING MAXIMUM PRICES OF SPIRITS SOLD IN PUBLIC BARS

  1. Subject to the provisions of this order, the maximum price that may be charged shall be—

For each standard measure of spirits sold in public bars in premises licensed under the Sale of Liquor Act 1962 or sold in public bars administered by any Licensing Trust.

  1. Where aerated water or cordial is added to any glass of spirits to which this order applies, the maximum price of such spirits may be increased by 4 cents a glass. Nothing in this paragraph shall affect the sale by the bottle of aerated water or cordial as a separate transaction.

FIXING THE MAXIMUM PRICES OF BEER SOLD FOR CONSUMPTION OFF THE LICENSED PREMISES

  1. Subject to the provisions of this order, the maximum price that may be charged for beer sold for consumption off the licensed premises shall be:

(a) For beer sold in bottles containing 750 ml the authorised price a bottle containing 750 ml ruling at the particular premises on 31 July 1977 increased by 5 cents a bottle.
(b) For beer sold in flagons, $1.32, except that in those areas where additional freight costs are incurred in obtaining supplies of draught beer, the price of beer sold in flagons shall be the authorised price ruling at the particular premises on 31 July 1977 increased by 11 cents.
(c) The additional charge for flagons supplied by the licensee shall not exceed 40 cents.
(d) No additional charge shall be made where an empty flagon is supplied by the customer.

GENERAL

  1. Notwithstanding anything in the foregoing provisions of the order and subject to such conditions, if any, as he thinks fit, the Secretary, on application by the licensee of any licensed premises may authorise special maximum prices in respect of any beer or spirits to which this order applies where special circumstances exist or for any reason extraordinary charges (freight or otherwise) are incurred by the applicant. Any authority given by the Secretary under this clause shall be exhibited in the manner prescribed by clause 11 below.

  2. Every licensee or manager of licensed premises, shall keep this Price Order or a statement of the retail prices prominently displayed—
    (a) In the public bar, and
    (b) In every place on the premises where draught beer in flagons, and bottled beer in bottles containing 750 ml is sold for consumption off the premises, in such a position as to be easily read by customers without having to ask for its production and without having to obtain permission to examine it.

Price Order No. 66 (Island Bananas—excluding Cook Island)

PURSUANT to the Commerce Act 1975, I, Peter Edward Donovan, pursuant to a delegation from the Secretary of Trade and Industry hereby make the following price order:

  1. This order may be cited as Price Order No. 66 and shall come into force on the 29th day of July 1977.

  2. (1) Price Order No. 46* is hereby revoked.

(2) The revocation of the said order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this order.

  1. References in this order to metropolitan areas are references to the metropolitan areas described in the Schedule hereto.

APPLICATION OF THIS ORDER

  1. This order applies with respect to Island bananas, excluding Cook Island, sold by way of retail in New Zealand.

MAXIMUM RETAIL PRICES OF ISLAND BANANAS—EXCLUDING COOK ISLAND

  1. (1) The maximum price that may be charged or received by any retailer for any Island bananas, excluding Cook Island, to which this order applies shall be:

(a) When sold by a retailer carrying on business in any of the metropolitan areas of Auckland, Wellington, Christchurch, or Dunedin, or in any of the Cities or Boroughs of Whangarei, Takapuna, Hamilton, Tauranga, Rotorua, Gisborne, New Plymouth, Stratford, Hawera, Wanganui, Palmerston North, Napier, Hastings, Masterton, Blenheim, Nelson, Greymouth, Timaru, Wesport, Oamaru, Balclutha, Gore, or Invercargill—

28 cents a lb.

Or where the scales used by the retailer weigh in metric weights—

62 cents a kilogram.

(b) When sold by a retailer carrying on business elsewhere—

29 cents a lb.

Or where the scales used by the retailer weigh in metric weights—

64 cents a kilogram.

(2) If in respect of any lot of bananas the price calculated in accordance with the foregoing provisions of this clause is not an exact number of cents, the maximum price of the lot shall be computed to the nearest whole cent.

PROVISIONS FOR SPECIAL PRICES

  1. Notwithstanding anything to the contrary in the foregoing provisions of this order, and subject to such conditions, if any, as he thinks fit, the Secretary, on application by any retailer, may authorise special maximum prices in respect of any Island bananas, excluding Cook Island, to which this order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred by the retailer. Any authority given by the Secretary under this clause may apply with respect to a specified lot or consignment of bananas, or may relate generally to Island bananas, excluding Cook Island, to which this order applies sold by the retailer while the approval remains in force.

DUTY IMPOSED ON RETAILERS

  1. Every retailer who offers or exposes for sale in any shop any Island bananas excluding Cook Island, to which this order applies shall keep in a prominent position, in such proximity to the bananas to which it relates as to be obviously in relation thereto, a ticket, placard, or label on which shall be stated in legible and prominent characters the following particulars:

(a) The retail price a pound of the bananas.

Or where the scales used by the retailer weigh in metric weights the price a kg.

(b) The word “Island”.
