  1. Finance General: (1) For a period being not more than 10 years, or for such lesser period as the council may by resolution decide, there shall be established for the purposes of finance a separate account in respect of each of the following areas, that is to say: that for the area of the former Ashley County an account to be known as the Ashley Division Account; and that for the area of the former Waipara County an account to be known as the Waipara Division Account shall be established (hereinafter referred to as “the separate accounts”).

(2) The separate accounts shall be debited or credited as the case may be with the net credit or debit balances of the funds of the former Ashley County and the former Waipara County respectively; and any money to the credit of each such separate account shall, after all liabilities have been provided for, be expended to the benefit of the residents of the area in respect of which such separate account is established; and any money required to be paid into such separate account to meet any deficiency therein shall be found within the area in respect of which such separate account is established.

  1. The separate accounts shall be kept in the manner provided for in Form 7 of the Local Government Accounting Regulations 1974.

  2. The valuation rolls, electors’ lists, electors’ rolls, and rate records in force in the former Ashley County and the former Waipara County shall continue in force in the county until new valuation rolls, electors’ lists, electors’ rolls, and rate records are made for the county.

  3. Town and Country Planning: The council of the county shall not be required forthwith to prepare a new district scheme for the whole of its district as required by section 28B of the Town and Country Planning Act 1953.

  4. Petroleum Tax: For the purposes of the Local Authorities (Petroleum Tax) Act 1970 the council shall be the successor to the Ashley County Council and the Waipara County Council.

  5. Accounting: For accounting and other financial purposes the union shall be deemed to have taken place at the commencement of the financial year in which the provisions of this order shall come into effect.

Union of Pongakawa and Te Puke Pest Destruction Districts to Form the Central Bay of Plenty Pest Destruction District (Notice No. 1697 Ag. 6/13/2/6A)

ORDER IN COUNCIL

At the Government Buildings at Wellington this 12th day of April 1977.

PURSUANT to the Agricultural Pests Destruction Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Union of the Pongakawa and Te Puke Pest Destruction Districts Order 1977.

(2) This order shall come into force on the 1st day of April 1977.

  1. The boundaries of the Pongakawa Pest Destruction District (which was constituted by Order in Council on the 25th day of March 1942*) and the Te Puke Pest Destruction District (which was constituted by Order in Council on the 16th day of June 1952†), are hereby declared united to form one district to be called the Central Bay of Plenty Pest Destruction District, the boundaries of which shall be those specified in the Schedule hereto.

  2. The basis on which the board for the said district shall first levy its general rate shall be the acreage of the land occupied by the ratepayer.

SCHEDULE

BOUNDARIES OF CENTRAL BAY OF PLENTY DESTRUCTION DISTRICT

The boundaries of the Central Bay of Plenty Pest Destruction District shall be that area of land contained in the following districts:

Pongakawa Pest Destruction District Order 1973, Gazette, No. 84, 13 September 1973, p. 1728.

Te Puke Pest Destruction District Order 1973, Gazette, No. 1, 11 January 1973, p. 6.

Member of Commerce Commission Appointed

PURSUANT to sections 3 and 4 of the Commerce Act 1975, His Excellency the Governor-General has been pleased to appoint:

company director, of Auckland, to be a member of the Commerce Commission for a term of 4 years, commencing on the 2nd day of May 1977.
