book certainly is wholly designed and written for “a young audience” and certainly does carry over 120 pictures and illustrations. The Tribunal, having deemed the book indecent in the hands of readers under a specified age, is in my view bound to have regard for the intention of section 11 (3) and relate it to the express purpose for which the book is written, illustrated, and published. This means declaring the book to be indecent in the hands of all persons. The only alternative to such a decision is to allow the book to be distributed without restrictions.

The Tribunal’s decision means that a book wholly aimed at young readers is deemed to be indecent in their hands, except in circumstances unlikely to be realised for the great majority of them. This is bound to attach undesirable interest to the book and place outside the law these young people who read it without adult instruction. I do not believe the intentions of the law or the intention of the authors and publisher are met by the decision.

In accordance with the majority opinion the Tribunal classifies Down Under the Plum Trees as indecent in the hands of persons under 18 years of age unless such persons are being instructed by parents or professional advisers.

National Roads Board—Declaring State Highway to be a Limited Access Road

It is notified that the National Roads Board, by resolution dated 16 March 1977, and pursuant to section 4 of the Public Works Amendment Act 1963, hereby declares that part of State Highway 6 (Queenstown to Frankton) from a line joining the north-eastern corner of Lot 12, D.P. 10787, to the eastern corner of Section 20, Block XXI, Shotover S.D., to the eastern boundary of the Borough of Queenstown, as more particularly shown on sheets 1 to 4 of plan L.A. 71/64/17 and accompanying schedule held in the office of the resident engineer, Ministry of Works and Development, Alexandra, and there available for public inspection, to be a limited access road.

Designation of South Otago Community Arts Council

PURSUANT to section 32 (i) of the Queen Elizabeth the Second Arts Council of New Zealand Act 1974, on the recommendation of the Southern Regional Arts Council and on the application of the South Otago Community Arts Council, the Queen Elizabeth II Arts Council of New Zealand hereby designates the South Otago Community Arts Council to be the Community Arts Council for the following duly defined area:

The Kaitangata, Balclutha, and Milton Boroughs and the Clutha and Bruce Counties.

Notice of Intention to Vary Hours of Sale of Liquor at Licensed Premises—King Country Licensing Committee

PURSUANT to section 221A (15) of the Sale of Liquor Act 1962, as amended by the Sale of Liquor Amendment Act 1976, I, Gordon Stewart Orr, Secretary for Justice, hereby give notice that the King Country Licensing Committee, on 11 March 1977, made an order authorising variations of the usual hours for the sale of liquor to the public, and further authorised the following hours of trading for the licensed premises known as Taumarunui Hotel:

(a) On each and every Friday, Saturday, and Christmas Eve (not being days when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening to be 11 o’clock in the morning, and the hour of closing to be 11 o’clock in the evening.

(b) On each and every New Year’s Eve (not being a day when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening to be 11 o’clock in the morning, and the hour of closing to be 0.30 o’clock in the morning of New Year’s Day.
