The Charitable Trusts Act 1957—Notice of Application for Approval of a Scheme under Part III of the Charitable Trusts Act 1957

NOTICE is hereby given that the Public Trustee as trustee of the will of Earnest Roberts White, late of Takapau, Hawke’s Bay, sheep farmer, deceased, has filed in the Office of the Supreme Court at Wellington an application for approval of a scheme by which a bequest having a value of $7,425 under the will of the deceased to the “Society for Prevention of Cruelty to Animals of New Zealand” for the general purposes of that society be paid in equal shares to the following societies:

(a) Dannevirke Society for the Prevention of Cruelty to Animals Incorporated;

(b) Hastings and District Society for the Prevention of Cruelty to Animals Incorporated;

(c) Hawke’s Bay Society for the Prevention of Cruelty to Animals Incorporated;

(d) Manawatu-Oruwa Society for the Prevention of Cruelty to Animals Incorporated.

Upon the grounds that it is impossible to give effect to the original bequest because no society known as the “Society for Prevention of Cruelty to Animals of New Zealand” does nor has ever existed but the four named societies do exist and have the principal object of encouraging an attitude of kindness to animals.

Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the Supreme Court, Wellington, and at the Public Trust Office at Waipukurau, Hastings, and Wellington.

The date proposed for the hearing of the application is the 27th day of April 1977.

Any person desiring to oppose the scheme is hereby required to give written notice of his intention to the Registrar of the Supreme Court at Wellington and to the Public Trustee, Wellington, and to the Attorney-General not less than seven clear days before that date.

S. F. DRUMMOND, Solicitor to the Public Trustee.

Wellington.
